was severe and permanent. Proceedings were instituted before the Industrial Commission against the University and the Athletic Association for compensation under the Workmen's Compensation Act. T h e Commission dismissed the proceedings so far as the University was concerned but held the Athletic Association liable as an employer. T h e Circuit Court of Champaign County also held the Athletic Association liable. T h e case was appealed to the Supreme Court of Illinois, and the Supreme Court held on September 21, 1943, that the trial court, which sustained the findings of the Industrial Commission, was in error. A detailed report on this case was made by Judge Sveinbjorn Johnson and presented to the Executive Committee on September 30, 1943. T h e Board (October 17, 1042, Minutes, pages 106-107) had previously authorized the University to join in an appeal to the Supreme Court. T h e case was finally closed when a rehearing was denied by the Supreme Court on November 11, 1043. I am reporting this so that the records of the Board will show that the case has been closed.

UNIVERSITY BUILDING PROGRAM (34) T h e College of Pharmacy has requested an appropriation of $61,000 to provide facilities for the study, development, and improvement of domestic plants for use in drug manufacturing. T h e project contemplates leasing from the Morton Arboretum in D u P a g e County 44 acres of land at a nominal rental, the purchase of ten acres of land adjacent to the Arboretum, construction of buildings and other facilities. This proposal was not included in the biennial budget for 1045-1047 nor in the post-war building program as finally submitted and approved by the Board of Trustees. It has, however, been considered by the University Building Committee, which recommends that the Medical Plant research project be approved and that the cost be included within the total of $2,000,000 approved by the Board of Trustees for the Chicago Colleges in the first biennium of the post-war building program. T h e Executive Dean of the Colleges of Medicine, Dentistry, and Pharmacy and the Dean of the College of Pharmacy have concurred in this recommendation. T h e University Council, which is advisory to the President in budgetary matters, and the Advisory Committee to the Bureau of Institutional Research, which acts for the Council in the preparation of biennial budget estimates, had authorized the University Building P r o g r a m Committee to act for them in consideration of this proposal. I concur in these recommendations and recommend further that the Board authorize the Chairman of the University Building Program Committee to request the Illinois P o s t - W a r Planning Commission to make the changes in the University's building program as previously presented to the Commission. It should be noted that this does not involve any increase in the total amount of the post-war building program. T h e Committee on Special Appropriations and Nonrecurring Expenditures has recommended that an appropriation of $2,800 be made for the purchase of 10.815 acres of land at the Morton Arboretum to begin this project, with the understanding that all further capital investments shall await the availability of funds for post-war projects. T h e operating costs of this small area would be carried in the budget of the College of Pharmacy. This is not entirely a new program but will replace one which has in the past been carried on at the Cook County Agricultural Experiment Station at Des Plaines, but this Station is no longer satisfactory for the purpose because of the industrial and other real estate developments in that area. I concur and recommend that an appropriation of $2,800 be made from the General Reserve Fund for this purpose.

On motion of Dr. Meyer, this recommendation was adopted and the appropriation was made, by the following vote: Aye, Mr. Fornof, Mrs. Grigsby, Mr. Karraker, Mr. Livingston, Mr. McKelvey, Dr. Meyer, Mr. Nickell; no, none; absent, Mr. Davis, Mr. Green, Mr. Jensen, Dr. Luken.
