"I move that the motions filed and objections not heretofore ruled upon presented to this Board by Assistant Professor Koch, through his counsel, be denied and overruled. "I move that the findings and conclusions submitted to the Board of Trustees by the Legal Counsel of the University at the conclusion of the evidence received and arguments presented at the hearing granted Assistant Professor Leo F. Koch, at his request, and held before this Board of Trustees on June 14, i960, be adopted by this Board of Trustees and stand as the findings and conclusions of this Board of Trustees in the proceeding resulting from the preferment of charges against Assistant Professor Leo F. Koch by the President of the University and the recommendation of the President of the University that Assistant Professor Leo F. Koch's present appointment at, and contract with, the University of Illinois be terminated on August 31, i960, and further move that said recommendation of the President of the University be approved and that Assistant Professor Koch's present appointment at, and contract with, the University of Illinois be terminated on that date." This motion was adopted by the following vote: Aye, M r . Clement, M r . Harewood, M r . Herrick, M r . H u g h e s , M r . Johnston, M r . Pogue, M r . Swain, M r s . Watkins, M r . Williamson; M r . Wilkins, who participated in the hearing and in the deliberations a n d who signed the findings and conclusions of the Board in this case was absent when the record vote was taken; no, none; Governor Stratton was not present at the meeting, and therefore did not participate in the hearing. At the request of President Williamson, the Secretary of the Board then read the conclusions of the Board in this case which are included in the reporter's transcript of the proceedings. Motion for Rehearing Following this reading, counsel for Dr. Koch orally moved for a rehearing of the case and also requested that the Board order its Secretary or other appropriate officer to prepare a duly certified copy of the record consisting of the pleadings and the evidence as well as a transcript of all or a portion of the argument, including specifically the argument of Legal Counsel for the University in chief a n d in rebuttal, and that of counsel for Dr. Koch in surrebuttal. Mr. Swain moved that the motion for a rehearing be overruled; and the motion to overrule was unanimously adopted by a voice vote. President Williamson stated that the request of counsel for Dr. Koch for a transcript of the proceedings of the hearing would be granted and that this would include: the arguments of Legal Counsel for the University; those of counsel for Dr. Koch; the findings and conclusions; the vote of the Board on the motion to deny and overrule the motions filed and objections presented by Assistant Professor Koch through his counsel; the motion to approve a n d adopt the findings and conclusions; the recommendation of the President of the University that D r . Koch's appointment be terminated on August 3 1 , i960; and the vote of the Board on the motion for rehearing. O n motion of M r . Swain, the Board then adjourned.
