I. That, whereas the said Thomas J. Smith desires to make a free and voluntary contribution to be used in the erection of a building for the Departments of Music of the University of Illinois, and for that purpose has proposed to grant and convey to the party of the second part the following1 described real estate, situated in the county of Champaign, State of Illinois: 1. The southwest quarter and the west half of the southeast quarter of section twenty-six (26), township twenty (20), range ten (10) east of the Third Principal Meridian, being two hundred and forty (240) acres more or less. 2. All that part of the north half, of section twenty-three (23), township twentytwo (22) north, range nine (9) east of the Third Principal Meridian, which lies west of the Illinois Central right of way, being two hundred and fourteen (214) acres, more or less. 3. The northwest quarter and south half of the northeast quarter of section thirty-one (31), township twenty-two (22) north, range eight (8), east ,of the Third Principal Meridian, less the Illinois Central right of way, being two hundred and forty (240) acres more or less. 4. The east half of the southwest quarter of section fourteen (14), township nineteen (19), range eight (8), east of the Third Principal Meridian, being eighty (80) acres more or less; and II. WHEREAS, The party of the second part desires to accept such voluntary contribution, and a conveyance to it of said lands; and III. WHEREAS, There is urgent need of a building for the Music Departments of the University of Illinois to be erected at a cost of not less than two hundred and fifteen thousand ($215,000) dollars; Witnesseth 1. That the party of the first part will immediately on the signing and delivery of this instrument in duplicate, convey by good and sufficient warranty deed to the party of the second part, all the lands above described, reserving the right of possession therein until the 1st day of March, 1915. 2. That the party of the second part will, on the delivery of said deed, instruct its Supervising Architect to draw plans and specifications for a building for the use of the Music Departments of the University of Illinois at a cost of not less than two hundred and fifteen thousand ($215,000) dollars. 3. That the party of the second part will cause to be erected on the Campus of said University such a building, in accordance with such plans and specifications, as soon as feasible. 4. That the party of the second part in consideration of such contribution will cause to be paid to the party of the first part, in the nature of an annuity, on the 1st day of September, .1915, the sum of three thousand two hundred and twenty-five ($3,225) dollars, and a like sum on the 1st days of March and September of each year thereafter during his natural life, and will pay to his executor or administrator for the six months immediately following the death of the party of the first part, a like sum of money. 5. That the party of the second part, in further consideration of such contribution, will grant annually in the University of Illinois four (4) free scholarships in the Music Departments for young women who may seek a musical education, but who are unable to pay the customary charges for instruction in music. The scholarships to be assigned by way of preference to candidates from Champaign County, In case there are no candidates from said county, they may be assigned to young women from other counties in Illinois. In witness whereof, the party of the first part has hereto attached his signature, and the undersigned officers of the party of the second part, authorized by resolution of their Board of Trustees, have hereunto attached their signatures as official representatives of the party of the second part, at the city of Urbana, State of Illinois, on the day of , 1914. On motion of Mr. Meeker, it was voted to adopt the agreement proposed by Capt. Smith, and the President and the Secretary of the Board of Trustees were authorized to sign the agreement on the part of the University.* The

* At the request of President James, the Secretary of the board presented to Capt. Smith the agreement signed by the proper officers of the board. Capt. Smith signed the agreement on September 14 and delivered the deed, properly drawn, signed, and attested, to the Secretary on September 17. The Secretary filed the instrument for record in the Recorder's Office of Champaign County on the same day and received a certificate showing that it was recorded in book 158 of deeds on page 299. The following is a THIS INDENTURE WITNESSETH, that the Grantor, Thomas J. Smith, a widower, of the city of Champaign, in the county of Champaign, and State of Illinois, for and in consideration of the sum of one dollar in hand paid, and other good and valuable consideration, CONVEYS AND WARRANTS to the Board of Trustees of the University of Illinois, of the county of Champaign and State of Illinois, the following described real estate, to wit: The southwest quarter of the west half of the southeast quarter of section twenty-six (26), township twenty (20), range ten (10) east of the Third Principal Meridian, all that part of the north half of section twenty-three (23), township twenty-two (22) north, range nine (9) east of the Third Principal Meridian,
