On motion of Mr. Nickell, these appropriations were, made as recommended, by the following vote: Aye, Mr. Fornof, Mrs. Grigsby, Mr. Karraker, Mr. Livingston, Mr. McKelvey, Dr. Meyer, Mr. Nickell; no, none; absent, Mr. Davis, Mr. Green, Mr. Jensen, Dr. Luken.

DEPOSIT OF CERTAIN FEDERAL F U N D S IN T H E STATE TREASURY

(7) On October 29, 1943, an informal report was made to the Board of the situation with respect to the deposit of certain federal funds in the State Treasury (copy of report attached). No formal action was taken on the matter, and it was referred to Messrs. Livingston and Nickell for conference with State officers. F u r t h e r consideration of the matter was given by the Executive Committee on January 26, 1944 (page 830), at which time the matter was referred to the President of the University. The subject has been studied by the Office of the Attorney General, which has reached the following conclusions: 1. While the General Assembly has given assent to the purpose of the various grants, it has not permanently designated the University of Illinois to receive moneys accruing thereunder. T h e latter has been done only for each successive biennial period. 2. T h e Treasurer can not receive the money as custodian unless the General Assembly has designated the way in which the money can be disposed of, which has not been done in this case excepting through the biennial appropriation bills. 3. An appropriation by the General Assembly is not necessary if other action is taken providing for the proper and continuous disposition of these funds. In accordance with these conclusions it appears that the situation can only be fully remedied by securing an action of the General Assembly designating the University of Illinois to receive the amounts becoming available under the various federal grants and authorizing the State Treasurer to receive these moneys as custodian and to disburse them on the order of the University. T h e Legal Counsel of the University, on request of the Comptroller, has drafted a suggested bill making these provisions. T h e draft has been reviewed and found satisfactory by the_ Legislative Reference Bureau. I recommend that authorization be granted to undertake to secure the introduction and passage of such a bill at the coming session of the General Assembly.

On motion of Mr. Karraker, the President of the University was given authority as recommended.

A M E N D M E N T O F UNIVERSITY CIVIL S E R V I C E LAW (8) In the 1943 session of the General Assembly an amendment to the State Civil Service Act was passed providing that persons employed in civil service
