sanitary sewer, water, telephone, and fire alarm) to within five feet of the building, including an extension of the steam tunnel from the south side of Green Street, north along the east side of Goodwin Avenue to the site. The above expenditures will be required for any construction undertaken oti this site. The Materials Research Project merely advances the time when such expenditures become necessary, b. Increase the funds for the construction of the Physical Plant Service Building—$152,000. These funds are required to vacate the Physical Plant facilities (in addition to those that would be vacated in the appropriation recommended by the Committee) now on the site. 2, Expansion of the land acquisition program, Urbana-Champaign — $600,000 This increase is recommended in order to: a. Provide additional staff office space. This is the most critical need of the University until construction is completed on new building projects. b. Make payments on properties purchased by the Foundation during tk current^ bienmum in excess of provisions made in the recommendations of the University Building Program Committee (the purchases developed following the submission of the Committee's report). 3. Increase in funds for public improvements—$236,503. This increase will k required to meet the University's proportionate share of public improvement sponsored by the Upper Embarrass River District^ the city of Urbana, the Urbana and Champaign Sanitary District, and the city of Champaign. In general, this increase results from the receipt of firm cost estimates whicli were only tentative at the time the University Building Program Committee report was submitted. Only one new project, a proposal by the dty of Champaign, has been added. The Committee recommends amending the building program for 1961-63 in include funds, totaling $1,461,503, for the additional improvements and land acquisitions described above. President Henry stated that he concurs in these recommendations. On motion of Mr. Swain, the building p r o g r a m for 1961-63 was

amended in accordance with the changes recommended above; this action was taken by the following vote: Aye, Mr. Clement, Mr. Harewood, Mr, Herrick, Mr. Hughes, Mr. Johnston, Mr. Pogne, Mr. Swain, Mrs. Watkins, Mr. Wilkins, Mr. Williamson; no, none; absent, Mr Kertier.

SUPREME COURT DECISION ON GARFIELD PARK LAND ACQUISITION

(30) As previously reported to the Board of Trustees, two actions were instituted in the Circuit Court of Cook County challenging the right_ of the Chicago Pari, District to convey certain lands in Garfield Park to the University of Illinois for use as the permanent site of a Chicago campus of the University. The plaintiff; in one action are three taxpayers who own land across the street from or in the immediate vicinity of the Garfield Park site. The plaintiffs in the other action are the People of the State of Illinois and two taxpayer interveners who own land located in the downtown Chicago business district. The Circuit Court in these proceedings held that the Act of the Genera) Assembly of Illinois, approved July 22, 1959, authorizing the Chicago Park District to convey park lands to the University, is unconstitutional and the Court enjoined the Chicago Park District from taking any steps to convey, and the University from taking any steps to acquire, any interest in Garfield Park. The Board of Trustees on September 21, I960, voted to appeal this decision without prejudice to any alternate sites which may be proposed by the city oi Chicago and its City Planning Department, and the appeal was taken.
