On motion of Mr. Hughes, this contract was awarded by the following vote: Aye, Mr. Clement, Mr. Dilliard, Mr. Hughes, Mr. Johnston, Mr. Jones, Mr. Page, Mr. Pogue, Mr. Swain, Mrs. Watkins, Mr. Williamson; no, none; absent, Governor Kerner.

REQUEST TO ILLINOIS BUILDING AUTHORITY TO INCREASE THE CONSTRUCTION CONTRACT FOR CHICAGO CIRCLE CAMPUS, PHASE II (15) T h e Director of the Physical Plant and the Vice-President and Comptroller recommend that the Board request the Illinois Building Authority to authorize an increase of $25,328.11 in the contract with the Gust K. Newberg Construction Co., Chicago, for construction of Chicago Circle Campus, Phase I I . This increase will make possible the substitution of face brick for the concrete block specified on the south wall of the Science and Engineering Laboratories Building. Funds are available for this work. I concur.

On motion of Mr. Jones, this change in contract was authorized.

EMPLOYMENT OF SARGENT & LUNDY FOR LONG-RANGE UTILITY CENTER AND DISTRIBUTION SYSTEM STUDIES AT CHICAGO CIRCLE CAMPUS (16) The Director of the Physical Plant and the Vice-President and Comptroller recommend the employment of Sargent & Lundy, Chicago, for long-range studies for expansion of the Utility Center and the related distribution systems at the Chicago Circle campus at an estimated cost of $28,500. The fee for this service will cover engineering and drafting costs at actual salaries and wages, plus 100 per cent for overhead and profit and other miscellaneous direct expenses at actual cost. Funds for this work are available in capital appropriations to the University for 1965-67 and have been released. I concur. O n m o t i o n of M r . J o h n s t o n , this r e c o m m e n d a t i o n w a s a p p r o v e d . ANTITRUST LITIGATION (17) On October 7, 1964, suit was filed on behalf of the University in the Federal District Court at Chicago (Case No. 64 C 1708) against certain manufacturers of metal library shelving who had been defendants in an earlier federal antitrust proceeding. On May 19, 1965, the Board authorized settlement with one of the defendants, and on October 13, 1966, settlement was authorized with certain other defendants. Subsequent negotiations with the remaining defendant (Sperry Rand Corporation) have developed a settlement offer from that company in the total amount of $52,000, representing approximately 30 per cent of the University's purchases from that company during the period in question. The offer to the University is contingent upon acceptance of similar settlement offers made by the defendant to certain state governments (including Illinois) and other educational institutions. Acceptance of the offer will result in a final disposition of the litigation. T h e Vice-President and Comptroller and the Legal Counsel regard the offer and settlement as reasonable and recommend it be approved and authorized by the Board. They further recommend that the Comptroller and the Secretary be authorized to execute and deliver such documents and papers as may be necessary and desirable to effectuate the settlement. I concur.

On motion of Mr. Swain, this recommendation was approved.

ESTATE OF RICHARD BARNES STITH (18) The University of Illinois is one of the beneficiaries under the Last Will and Testament of Richard Barnes Stith, deceased. The composition of the estate and the University's ultimate participation are dependent upon the interpretation of Mr. Stith's Will as well as the wills of other persons who predeceased him. The decedent's son has filed a suit in the Circuit Court of the
