The University has been negotiating with both the owner, who does not wish to sell for any price, and the tenants, who are willing to sell their rights, but only at a price deemed excessive for their interests. Funds are available from a federal grant from the Bureau of Outdoor Recreation of the Department of the Interior, from a gift from Chicago Community Trust (subject to a charge on the property for one-half the net proceeds of sale if the property is sold within fifty years), and from other private contributions, with the exception of $5,800 which is available in the Chicago Circle Contract Research Reserve. Resolution Authorizing Condemnation of "Peacock Prairie" Property, in Cook County, Illinois Be It, and It Is Hereby Resolved, Found and Declared by The Board of Trustees of the University of Illinois, a body corporate and politic and a public corporation of the State of Illinois, that the following-described real estate situated in the County of Cook, in the State of Illinois, to-wit: The South 350 feet measured along the West line of Greenwood Pfingston Road, of that part of the West One Half ( W Y2) of the South-West One Quarter ( S W VA) of Section Eleven (Sec. 11), Township Forty-One North (T 41 N ) , Range Twelve East (R 12 E) of the Third (3d) Principal Meridian, which lies north of and adjoining the north line of Lot 3 in Owner's Division of Part of said West One Half (W i/2) of said South-West One Quarter ( S W VA) of said Section Eleven (Sec. 11), situated in Maine Township, in the County of Cook, and State of Illinois; is needed by the University of Illinois, an educational institution established and supported by the State of Illinois, for use by the Department of Biological Sciences at the University of Illinois at Chicago Circle for teaching and research purposes, and for other educational purposes conducted and to be conducted by said University of Illinois, and for the expansion of the educational facilities of said University of Illinois, and to enable said University of Illinois to discharge its duty_ to the People of said State, and for public use; that funds are available to the University for the purchase of said land for said educational purposes; that this Board of Trustees has negotiated with the owner of and tenants on said land through their duly authorized representatives for the purchase of said land at a price which this Board of Trustees considers fair and reasonable and which it finds constitutes the present market value of said land, but that said owner and tenants have refused and continue to refuse to sell and convey their respective interests in said land, or any portion thereof, to said The Board of Trustees of the University of Illinois for such price; and Be It, and It Is Hereby Further Resolved, Found and Declared by The Board of Trustees of the University of Illinois that the compensation to be paid by it for said land cannot be agreed upon between this Board of Trustees and the owner and tenants of said property, and it and they are unable to agree upon a purchase price to be paid to said owner and tenants for the sale and conveyance of said land and their respective interests therein by said owner and tenants to said The Board of Trustees of the University of Illinois; and Therefore, Be It, and It Is Hereby Further Resolved, Found and Declared by The Board of Trustees of the University of Illinois that because of said need of the University of Illinois for said land for the purposes hereinabove set forth and because the compensation to be paid to the owner and the tenants thereof for their respective interests in such land cannot be agreed upon between them and this Board of Trustees, it is necessary for The Board of Trustees of the University of Illinois to take said land and acquire title thereto through the exercise by it of the right of eminent domain conferred upon it by law and to have the compensation to be paid by it to the owner thereof and any and all other persons who may have any right, title or interest in and to said land determined in the manner provided by law for the exercise of said right and power of eminent domain; and Be It, and It Is Hereby Further Resolved by The Board of Trustees of the University of Illinois that the necessary and appropriate action be taken for the acquisition of title to said property by said The Board of Trustees of the University of Illinois and to have the compensation to be paid therefor determined by the institution and prosecution to completion of a proceeding in eminent domain in a
