This Indenture Witnesseth: That Whereas, the undersigned, The Board of Trustees of the University of Illinois, a public corporation, did, by warranty deed, on August I, 1938, convey and warrant t o T h e University of Illinois Foundation, a not for profit corporation organized and existing under and by virtue of the laws of t h e State of Illinois, the following described tract of land and premises, viz.: Commencing a t the Northwest corner of the Northeast one-quarter of Section 18, Township 19 North, Range 9 East of the Third Principal Meridian, which corner is taken t o be the intersection of the middle line between curbs of Springfield Avenue in t h e City of Urbana with the line of the back of the East curb of Wright Street; thence south 897.38 feet along the center line of Section 18, which line is also the line of the back of said East curb of Wright Street, to a point which is 425.63 feet North of a brass rod embedded in concrete at the intersection of the center line of John Street with the back of the East curb of Wright Street; thence North 89 degrees 47 minutes E. 281.95 f e e t along the South line of Green Street, as determined by the South edge of a concrete walk, to the Northwest corner (as the place of beginning) of the tract covered hereby and described as follows: Beginning a t said Northwest corner, thence N. 89 degrees 47 minutes E. 340 feet along the South line of Green Street; thence S. zero degrees 13 minutes E. 300 feet; thence S. 89 degrees 47 minutes W. 340 feet; thence N. zero degrees 13 minutes W. 300 feet to the point of beginning, said tract being a part of the South portion of the West one-half of the Northwest one-quarter of the Northeast one-quarter of Section 18, Township 19 North, Range 9 East of the Third Principal Meridian, all in Champaign County, Illinois, and which said deed was filed for record in the office of the Recorder of Deeds of Champaign County, Illinois, on August 6, 1938, and duly recorded in Book 240 of Deeds on page 409; and which said tract of land and premises are hereinafter for convenience sometimes called the building site; and Whereas, said T h e University of Illinois Foundation did, on August 1, 1938, convey and mortgage said building site to The Connecticut Mutual Life Insurance Company, a corporation, as security for the payment of mortgage indebtedness in

the principal sum of F I V E H U N D R E D F I F T Y THOUSAND DOLLARS ($550,000.00), and

which said mortgage was, on August 6, 1938, duly recorded in Volume 348 of the Mortgage Records in said Recorder's office on page 129; and Whereas, a t the time of the execution and delivery of said Deed of Conveyance and the said Mortgage, there existed and still exists a means of ingress and egress to and from the said building site over a certain paved way and sidewalks lying immediately north of said building site, and which said paved way and sidewalks extend in a general easterly and westerly direction between and continuously with and in the same general line as the paved way and sidewalks on Green Street in the City of Champaign, Illinois, and Green Street in the City of Urbana, Illinois, and lie between Wright Street in the City of Champaign, Illinois, and Mathews Avenue in the City of Urbana, Illinois, which means of egress and ingress to and from the said building site was intended by said deed to inure to the benefit of the said building site so conveyed by the said deed and to the owners thereof; and Whereas, it is also the intention of the parties hereto that no question be raised with regard to the true and lawful location of said paved way and sidewalks furnishing said means of egress and ingress and that for the purposes of said deed they be considered as properly and lawfully located in their present location as now used. Now, therefore, the grantor, The Board of Trustees of the University of Illinois, a public corporation in the State of Illinois, for and in consideration of One Dollar ($1.00) in hand paid, and other good and valuable considerations, receipt whereof is hereby acknowledged, and to more fully and completely express the intention of the parties a t the time of the execution of said deed hereinabove described, recorded in book 240 of Deeds on page 409, does hereby covenant and agree that the present existing means of access, ingress and egress t o and from the said building site so described in said deed recorded in Book 240 of Deeds on page 409, shall forever inure to the benefit of t h e said building site and to the owners thereof, and all persons now or hereafter having any interest therein or having any lawful right to enter in or upon the said building site, and to that end and purpose does hereby convey and warrant, as an easement appurtenant to said building site,
