entitle him to a retiring allowance in excess of that provided by the present regulations which limit the number of years of service which m a y be taken into consideration in calculating the amount of the allowance to twenty-five years and limit the m a x i m u m allowance to one-half of the average amount of compensation during the last five years prior to retirement. After careful consideration of this question the committee reports that while the members of the committee appreciate the great value of the unusually long period of efficient and loyal service rendered by Profssor Barton, the provisions of the regulations governing retiring allowances clearly limit the retiring allowance in all cases of this character to one-half of the average amount of compensation received by the person w h o is retiring during the last five years of his employment prior to his retirement without regard to the period of service in excess of twenty-five years. These regulations were a part of Professor Barton's contract of employment during the year 1925-26 and fix his rights and obligations. The committee, therefore, recommends that the retiring allowance of Professor Barton be based on the provisions of the regulations governing retiring allowances as now drawn. O n m o t i o n of M r . A r m s t r o n g , this r e c o m m e n d a t i o n w a s adopted. In the case of Professor O. A. Harker, his retiring allowance when calculated by the method provided by the regulations exceeds the m a x i m u m allowance which members of the University Staff, with a rank other than that of President or Dean, m a y receive. The question presented is whether or not the fact that Professor Harker was Dean of the College of L a w for m a n y years prior to and including the year 1916-17 and that he served as Acting Dean of the L a w School during the year 19201921 should not entitle him to have his allowance calculated with reference to the m a x i m u m allowance provided for members of the staff with the rank of "Dean." While the committee recognizes the long and efficient service of Judge Harker as Dean of the College of Law, the facts are that at the time of his retirement and for several years prior thereto his rank was other than that of Dean and his rank at the time of his retirement is made the controlling factor by the regulations in determining the m a x i m u m allowance to which he m a y be entitled upon retirement. The committee recommends, therefore, that Judge Harker's retiring allowance be calculated upon the basis provided by the regulations for determining the retiring allowance of members of the staff with the rank of Professor. O n m o t i o n of M r . W h a m , this r e c o m m e n d a t i o n w a s adopted. The questions which are presented by Professor Goebel for consideration by the Board in determining the amount of the retiring allowance which he is entitled to receive are as follows: 1. Has Professor Goebel been treated fairly in the matter of salary during the years which affect his retiring allowance? 2. In view of the former question, is his retiring allowance calculated under the provisions of the regulations governing retiring allowances upon the salary actually received by him, as large as it should be? The committee reports with reference to the foregoing questions that, after a careful consideration of the evidence presented, it is unable to say that Professor Goebel has been dealt with unfairly in the matter of salary or otherwise either by President Kinley or the Board of Trustees. The committee therefore recommends that Professor Goebel's retiring allowance be calculated upon the salary received by him during the last five years of his employment preceding his retirement as provided by the regulations governing retiring allowances.
