Meeting of June 4, 1907.

A special meeting of the Board of Trustees of the University of Illinois was held at the Auditorium Annex in Chicago, Tuesday June 4, 1907, pursuant to the following notice which was. sent out by the secretary May 28, 1907:

Upon t h e call of t h e p r e s i d e n t of t h e board, Mr. W. L. Abbott, t h e r e will be a m e e t i n g of t h e Board of T r u s t e e s of t h e University of Illinois at 9:00 o'clock a. m., Tuesday, J u n e 4, 1907, a t t h e A u d i t o r i u m A n n e x in Chicago, for t h e purpose of g r a n t i n g a u t h o r i t y to confer diplomas on those t o be g r a d u a t e d t h a t day from t h e College of Medicine of t h e University, a n d to t r a n s a c t such o t h e r business as m a y be duly presented.

When the board met pursuant to this call the following members were present: Messrs. Abbott, Davison, Hatch, McLean, Madden, and Mrs. Evans and Mrs. Busey; absent, Governor Deneen and Messrs. Blair and Lehman and Mrs. Alexander. President James was present.

Report of t h e second m e e t i n g of t h e N a t i o n a l Commission for t h e Invest i g a t i o n of N u t r i t i o n Problems. T h e second m e e t i n g of t h e Commission for t h e I n v e s t i g a t i o n of N u t r i t i o n Problems w a s h e l d a t t h e University of Illinois, U r b a n a , Illinois, May 10th and 11th. P r e s e n t , t h e c h a i r m a n , Prof. J . J. Abel of J o h n s H o p k i n s University, Professor R. H. Chittenden of Y a l e University, Professor T h e o b a l d Smith of H a r v a r d University, Professor A. P. M a t h e w s of t h e University of Chicago, Professor H. S. Grindley of t h e University of Illinois. T h e commission took u p in detail t h e p l a n of t h e squad e x p e r i m e n t s w h i c h h a d been p r e p a r e d b y Professor Chittenden a n d t h e s e c r e t a r y of t h e commission, in accordance w i t h t h e r e q u e s t of t h e commission a t i t s first m e e t i n g . Action w a s t a k e n a s r e p o r t e d in t h e m i n u t e s of t h e m e e t i n g w h i c h have been filed w i t h t h e s e c r e t a r y of t h e board. T h e following is an opinion from Professor O. A. H a r k e r , counsel for t h e University, in r e g a r d to t h e legal liability of t h e University involved in t h e c a r r y i n g o u t of t h e squad e x p e r i m e n t s , i n c l u d i n g t h e proposed pledge of t h e subjects of t h e h y g i e n i c t a b l e : Professor H. S. Grindley: SIR—I am unable to find in the published reports of courts of last resort in this country that there has ever been any adjudication on a question likely to arise in carrying on food experiments under any plan resembling the one proposed for the University. We have in our law library all the published reports of the United States Supreme Court and Circuit Courts and all the published reports of courts of last resort in all of the states of the Union excepting Alabama, Arkansas, Delaware, and Louisana. I can find in none of these reports any adjudication or even discussion of a question that is at all likely to arise under the plan . that you submit to me. An opinion on your 'plan' must necessarily be, as we lawyers express it, 'an opinion of first impression.'
