BOARD OF TRUSTEES

This indenture made this 29th day of October, 1943, by and between the Board of Trustees of the University of Illinois, party of the first part, and the Commissioner of Highways of the Town of Tolono, Champaign County, Illinois, party of the second part: IVitnesseth: Whereas, the party of the first part is the owner in fee simple of the following described real estate, to wit: T h e Southwest Quarter ( S W ^ ) of Section T w o ( 2 ) , the Southeast Quarter ( S E J 4 ) of Section T h r e e ( 3 ) , the Northeast Quarter ( N E J 4 ) of Section Ten (10), and the Northwest Quarter ( N W J 4 ) of Section Eleven (11), all in Township 18 North, Range 8 East of the Third Principal Meridian; which said real estate adjoins and abuts portions of certain roads located within the Town of Tolono, Champaign County, Illinois, as follows: T h a t portion of the public highway running north and south the center line of which lies between Sections Two (2) and Three (3) and between Sections T e n (10) and Eleven (11), beginning at the Northwest corner of the Southwest Quarter of Section T w o (2) (which is also the Northeast corner of the Southeast Quarter of Section Three ( 3 ) ) and extending south one mile more or less to the Southeast corner of the Northeast Quarter of Section Ten (10) (which is also the Southwest corner of the Northwest Quarter of Section Eleven ( 1 1 ) ) , also that portion of the public highway running east and west the center line of which lies between Sections Three (3) and Ten (10) and between Sections Two (2) and Eleven (11), beginning at the Southwest corner of the Southeast Quarter of Section Three (3) (which is also the Northwest corner of the Northeast Quarter of Section T e n (10)) and extending east one mile more or less to the Southeast corner of the Southwest Quarter of Section Two (2) (which is also the Northeast corner of the Northwest Quarter of Section Eleven ( 1 1 ) ) , all in Township Eighteen (18) North and Range Eight (8) East of the Third Principal Meridian, and all in Tolono Township, in Champaign County, Illinois; and Whereas, the Board of Trustees of the University of Illinois propose to construct an airport upon the above described premises and it is necessary for such purpose that the above described roads be vacated; and Whereas, the public interest will be served in the construction of said airport and it is necessary and essential that said roads be vacated for that purpose: Now, therefore, in consideration of the vacation of said above described roads by the Commissioner of Highways of the Town of Tolono, Champaign County, Illinois, and for other valuable considerations, the party of the first part hereby releases and waives any and all claims for damages by reason of the vacation of said roads so abutting and adjoining the above described real estate owned in fee by said party of the first part, and hereby discharges and releases the said Commissioner of Highways of the Town of Tolono, Champaign County, Illinois, and the Town of Tolono, Champaign County, Illinois, from any claims or demands whatsoever by reason of the vacation of said roads. Cunningham, who are personally known to me and known to me to be respectively President and Secretary of the Board of Trustees of the University of Illinois, and known to me to be the identical persons whose names are affixed to the above instrument as such President and Secretary respectively, and who, being by me severally duly sworn, each for himself did say that he Park Livingston is the President and he H. E. Cunningham is the Secretary of said Board of Trustees of the University of Illinois and that the seal affixed to said instrument is the seal of said Board of Trustees of the University of Illinois and
