1943 J UNIVERSITY OF ILLINOIS 737 VACATION OF HIGHWAYS AT AIRPORT (14) A recommendation that a resolution, prepared by Chapman and Cutler, be executed and adopted to secure the vacation of certain highways at the University airport. Resolution releasing all claims for damages by reason of the vacation of portions of certain roads in the Town of Tolono, Champaign County, Illinois, abutting and adjoining lands owned and acquired by the University of Illinois for an airport. Whereas, the Board of Trustees of the University of Illinois have acquired or have under contract to acquire and will acquire the fee simple title to the following described real estate located in the Town of Tolono, Champaign County, Illinois, to wit: T h e Southwest Quarter ( S W J 4 ) of Section Two ( 2 ) , the Southeast Quarter (SE^4) of Section Three ( 3 ) , the Northeast Quarter (NEJ4) of Section Ten (10), and the Northwest Quarter ( N W J 4 ) of Section Eleven (11), all in Township 18 North, Range 8 East of the Third Principal Meridian; and Whereas, said real estate, together with other real estate, is being acquired for the construction of an airport, appropriations having been made by the Legislature of the State of Illinois for the acquisition thereof, and also for the improvement of the same, which appropriations, together with funds to be received from the. Civil Aeronautics Administration, are to be used for the construction, maintenance, and operation of an airport and landing field upon the property hereinabove described and referred t o ; and Whereas, it is essential and necessary in the construction of said airport that the portions of certain roads bisecting the above described property be vacated, the portions of the roads to be vacated being described as follows: That portion of the public highway running north and south the center line of which lies between Sections Two (2) and Three (3) and between Sections Ten (10) and Eleven ( n ) , beginning at the Northwest corner of the Southwest Quarter of Section Two (2) (which is also the Northeast corner of the Southeast Quarter of Section Three ( 3 ) ) and extending south one mile more or less to the Southeast corner of the Northeast Quarter of Section Ten (10) (which is also the Southwest corner of the Northwest Quarter of Section Eleven ( n ) ) , also that portion of the public highway running east and west the center line of which lies between Sections Three (3) and Ten (10) and between Sections Two (2) and Eleven (11), beginning at the Southwest corner of the Southeast Quarter of Section Three (3) (which is also the Northwest corner of the Northeast Quarter of Section Ten (10)) and extending east one mile more or less to the Southeast corner of the Southwest Quarter of Section Two (2) (which is also the Northeast corner of the Northwest Quarter of Section Eleven ( 1 1 ) ) , all in Township Eighteen (18) North and Range Eight (8) East of the Third Principal Meridian, and all in Tolono Township, in Champaign County, Illinois; and Whereas, a petition is now pending before the Commissioner of Highways of the Town of Tolono, Champaign County, Illinois, for the vacation of the above described portion of said roads and it is the desire of this Board of Trustees that the vacation thereof be facilitated and it is for the best interests of the University of Illinois, as the owners of the real estate abutting and adjoining the portion of said roads proposed to be vacated, to waive and release said Town of Tolono and the Commissioner of Highways of said Town from any claim for damages by reason of the vacation of said r o a d s ; Now, therefore, be it and it is hereby resolved, by the Board of Trustees of the University of Illinois, as follows: Section 1. That the President and Secretary of this Board of Trustees of the University of Illinois, upon the acquisition of the fee to the property first above described, be and are hereby authorized to execute a release of all damages and claims of any kind or character whatsoever by reason of the vacation of the roads in the Town of Tolono adjoining and abutting the property so acquired as aforesaid by the University of Illinois, said release to be in substantially the following form:
