as a result of the operation of the investigation, or if such liability is otherwise covered. The rate may also be reduced if justified by experience. The sums thus accumulated will be carried in a reserve account from which such claims will be paid. (b) Indirect costs, which consist of general college and departmental administrative costs, physical plant operating costs, and use of departmental, college, and general University facilities. This budget shall be approved by appropriate administrative personnel, including the Business Office. To protect the general interests of the University as well as the interests of the department concerned, the amount budgeted for indirect costs in any such proposed project shall be reviewed and approved by a committee consisting of (a) the Chairman of the Research Board, or his delegate, who in Chicago shall be the Vice-President in charge of the Professional Colleges, (b) a representative of the appropriate research agency or the department carrying on the project, and (c) a representative of the Business Office. When the aggregate sum received from a private individual, corporate body, foundation, or the Federal Government for sponsored research during any fiscal year shall be less than $5,000, such review shall not be required. In determining the amount to be budgeted for indirect costs, the Committee shall give consideration to the respective benefits which will be received from the investigation by the sponsor, by the University, and by the Public. The projects will vary from those which are mainly for the benefit of the sponsor to those which are directly supplemental to University research programs and interests, and which provide funds for desirable expenditures which the University otherwise might not be able to make. When the budget provides for full recovery of all indirect costs, the following distribution of such funds is to be made: a. 40 per cent to a reserve which will periodically lapse to general University income. Special administrative or physical plant costs which result from such research activities may be charged directly to this reserve. b. 30 per cent to a reserve fund to be allocated by the University Research Board for research purposes. c. 30 per cent to the University department conducting the investigation. In those cases where less than total reimbursement of indirect costs is authorized by the Committee, then all sums received for this purpose shall first be applied to the general University allocation under "a" above. After the full 40 per cent provided has been realized, any balance shall then be applied to "b" above, and after such 30 per cent has been realized, any remaining balance will be applied to "c". In certain cases, on projects where unusual demands are made upon University facilities, or substantial capital installations are required to service the project, or in other instances where full use of University facilities is not required, the Committee is authorized to revise the percentage allocation provided above.

On motion of Mrs. Holt, these changes were approved.

REPORT O N LITIGATION IN THE CASE OF VIRGINIA A. KENNY VS. T H E BOARD OF TRUSTEES

(10) In June, 1948, Miss Virginia A. Kenny, a nonacademic employee in medical social service work in the Research and Educational Hospitals, instituted legal proceedings in the Superior Court of Cook County to obtain a writ of mandamus to compel the Board of Trustees to place her in the position of Head of the Social Service Department of the Research and Educational Hospitals. Miss Kenny had then been on the staff, in a civil service position, since September 1, '941, and up to 1945 was the only medical social worker employed in the Hospitals. Subsequently other medical social workers were employed in the same civil service classification as Miss Kenny. The Board of Trustees had created the position "Director of Social Service" pursuant to a plan for the reorganization and expansion of social service functions, including provisions for the professional training of medical social service
