the Illinois Commerce Commission, will be seven cents per ioo cubic feet per quarter, instead of the rate of nine cents previously requested for softened water. While softened water is desirable, it is not essential and was not requested by the University. It was originally proposed that the Company would provide and maintain all metering facilities. T h e meters were to be of the volumetric type with straight reading horizontal register and recording only the volume consumed, and not the rate of flow. From the University's point of view, recording the rate of flow is desirable. Contracts for the University's water station improvements now under construction call for a Venturi meter which will record both rate of flow and quantity consumed. Installation of an additional meter by the Water Company would require the University to construct a meter vault. T h e Company is willing to use the Venturi meter provided by the University. T h e contract as now drafted provides that: a. The Water Company will proceed as rapidly as possible to deliver water needed by the University. b. Not later than two years from the date of the agreement it will begin to furnish the entire requirements of the University. c. In the interim the University will use its own facilities and supply together with water purchased as needed. d. After the Company begins to supply the entire requirement, the University facilities will be maintained for emergency use only. e. T h e adequacy of water service will be determined by the National Board of Fire Underwriters. f. T h e quality of water furnished will be based on the standards of the United States Public Health Service for drinking water. g. If the Water Company at any time fails to furnish an adequate or potable supply or to take steps toward correcting any deficiencies within six months, the University is relieved of its obligations under the contract. h. Subject to constitutional and statutory limitations on biennial appropriations, the agreement runs for thirty years subject to the right of either party to terminate at the end of any ten-year period on two years' written notice. i. T h e University agrees to comply with all rules and regulations of the Water Company approved by the Illinois Commerce Commission, and shall have a period of five years in order to install such facilities and to do the work required to comply with such regulations. Water furnished under this agreement may be used by the University for cooling purposes or other processing purposes comparable with any industrial use permitted by the W a t e r Company. Chapman and Cutler, attorneys of Chicago, have recommended that the Board of Trustees adopt the following resolution: Be It Resolved by the Board of Trustees of the University of Illinois that the following agreement for the purchase of water by the University of Illinois from the Illinois Water Service Company, to wit:

AGREEMENT FOR PURCHASE OF W A T E R

This agreement, made and entered into this 2ist day of April, 1049, by and

between ILLINOIS W A T E R SERVICE COMPANY, a private corporation organized and

existing under the laws of the State of Illinois (hereinafter referred to as the "Water Company"), and the UNIVERSITY OF ILLINOIS, a public corporation organized and existing under and by virtue of the laws of the State of Illinois (hereinafter referred to as the "University"), WITNESSETH, as follows: Whereas, the Water Company is a public utility subject to regulation by the Illinois Commerce Commission and owns and operates a system of wells, together with water treatment facilities, water mains and distribution facilities, and is presently engaged in the business of furnishing water service in the Cities of Champaign and Urbana, Illinois; and Whereas, the University likewise owns certain wells, a distribution system and other facilities capable of furnishing a part of the water service requirements of the University; and
