Whereas, the University on February 16, 1942, entered into a memorandum of agreement known as Contract OEMsr-241 with the United States of America for carrying on a certain research in its laboratories, which research is therein described and not in this resolution set forth because the contract aforesaid is "Restricted"; and Whereas, sundry amendments of said contract have from time to time been made and executed by both parties, the latest of which is dated J u n e 1, 1944, which modification continues in full force and effect article 5, paragraphs ( a ) and (b) of a memorandum of supplemental agreement in relation to the contract aforesaid, to wit, Contract No. OEMsr-241, wherein it is provided that the University of Illinois shall make a disclosure to the Government of any inventions made in carrying out the subject work and shall designate in writing "which of the said inventions shall have or will be covered by applications or patents filed or caused to be filed by the contractor. T h e contractor (University) shall have the right . . . to elect whether it or the Government shall file applications for patents or inventions . . ."; and Whereas, under the contract above described the University has the right of election as heretofore stated and is obligated to inform the United States Government whether it chooses to exercise the right of filing application for a patent on any such inventions or discoveries; Now, therefore, be it resolved by the Executive Committee of the Board of Trustees exercising the full powers of the Board of Trustees under the charter of the University, that the University retain application for patent, Ser. No. 534,060, filed May 4, 1944, covering magnetic induction accelerator with small X-ray source, which discovery was made by Donald W . Kerst and Robert Serber, and that this resolution, together with the action of the Board of Trustees on February 20, 1943 (Minutes, page 283), and of the Committee on Patents in pursuance thereof, shall be deemed an exercise of right of election by the University ; and Be it further resolved that the University of Illinois, the Board of Trustees, and this Executive Committee acting in its behalf, hereby grant and tender unto the United States of America under and pursuant to the provisions of the contract aforesaid a non-exclusive irrevocable royalty-free license "to make, have made, and use for military, naval, and national defense purposes, and sell or otherwise dispose of in accordance with law, material, and to use processes" under and pursuant to the discovery hereinbefore described; and Be it further resolved, subject to the within and foregoing reservations and stipulations, that the University, the Board of Trustees, and this Executive Committee acting in its behalf, agree to the imposition of such secrecy in relation to the discovery and application aforesaid and the use thereof as applicable statutes, executive orders, or directives may authorize or require in the national interest, pursuant to the first paragraph of Sec. 42, Title 35, USCA. LEASE OF SKATING RINK TO TIME, I N C .

The Comptroller presented the following statement.

Time, Inc., publishers of Time, Fortune, Life, and Architectural Forum, is considering the location of a part of its Circulation Department at ChampaignUrbana. It desires to lease space for the coming year, during which time the possibilities of a more permanent location will be studied. It has indicated its desire to lease a substantial portion of the Skating Rink as an office and work space for its clerical force, including the entrance section of the building and about one-half of the arena. T h e Athletic Association has indicated that it is impracticable to operate the Skating Rink during the coming season, so that the building is available for rental during this year, and such a rental would make it possible to recover fixed expenses. T h e matter has been reviewed fully by Director Havens, Director Mills, and Comptroller Morey who have offered the following tentative plan of lease: 1. Tenant to have use of the above area described for the purposes stated, including toilet rooms and other necessary service areas aggregating about 38% of the gross area of the building. T h e University would have access to the remaining area for storage or other purposes not interfering with the work of the tenant.
