President Livingston introduced M r . A m o s H . W a t t s who reported on correspondence with the Civil Aeronautics Administration with respect to the resolution adopted by the Board on December 18, 1943 (Minutes, page 8 1 1 ) . M r . W a t t s stated that the Administration had taken exception to certain statements incorporated in the resolution, and had requested that the resolution be reconsidered and revised so that it should conform to the rules of the Administration and to similar arrangements in the case of other airports. Mr. W a t t s recommended that the changes be approved by the Board as requested by the Civil Aeronautics Administration, and that the Secretary be authorized to supply such certified copies as the Administration may require. After full discussion, the Board voted, on motion of Mr. McKelvey, to reconsider its action of December 18, 1943, as contained in pages 811 to 814 inclusive, under the heading "Resolution for Operation of Airport." O n motion of M r . McKelvey, the action of the Board in adopting the above resolution was annulled, and the resolution was rescinded. O n motion of Mr. Davis, the resolution as amended, and as given below, was adopted, and the Secretary was instructed to supply properly certified copies, including the certification of the attorney and the sketch attached, to the Civil Aeronautics Administration. This action was taken by the following vote of record: Aye, M r . Davis, Mr. Fornof, M r s . Grigsby, Mr. Jensen, Mr. K a r r a k e r , Mr. Livingston, Dr. Luken, Mr. McKelvey; no, n o n e ; absent, Mr. Green, Dr. Meyer, Mr. Nickell. RESOLUTION

CONSTITUTING AGREEMENT WITH UNITED STATES RELATIVE TO OPERATION AND MAINTENANCE OF THE UNIVERSITY OF ILLINOIS AIRPORT

Whereas the Administrator of Civil Aeronautics of the United States Department of Commerce (hereinafter referred to as the "Administrator"), with the approval of a Board composed of the Secretary of War, the Secretary of the Navy, and the Secretary of Commerce, has designated as necessary for national defense a project (herein called the "Project") for the development of the University of Illinois Airport (herein called the "Airport"), which project is identified as 904-11-17. Whereas as a condition precedent to release and operation of the project, the Administrator requires that the University have certain property interests in the landing area of the Airport and the lands to be improved under the project and enter into an agreement with the United States (herein called the "Government") in the manner and form hereof; and Whereas the University is legally, financially and otherwise able to enter into such an agreement and desires to avail itself of the benefits of prosecution of the project: Now, Therefore, Be It Resolved by the Board of Trustees of the University of Illinois'. Section 1. That for and in consideration of the development of the Airport by the Government, as contemplated by the project, the University does hereby covenant and agree with the Government as follows, this agreement to become effective upon the award of any construction contract for any portion of the project or the inauguration of any portion of the project under force account, and to continue in full force and effect during the useful life of any improvements made under the project: (a) The Government shall have the right to determine what improvements are to be made under the project, and the manner in which the project is to be
