Block 1 of J. S. Wright's Addition to said City of Champaign, and being marked with a cross cut in a concrete slab; thence southerly along the east property line of Sixth Street, a distance of 158.0 feet to a corner, said corner being marked with an iron pipe; thence easterly a distance of 60.0 feet to a comer, said corner being marked with an iron pipe; thence northeasterly a distance of 7755 feet to a corner, said corner being marked with an iron pipe; thence northerly and parallel with the east property line of Sixth Street, a distance of 103.27 feet to a corner, said corner being marked with an iron pipe; thence westerly along a line parallel with the south line of said Block I of said J. S. Wright's Addition to said City, a distance of 115.0 feet to the place of beginning, upon the terms, provisions, and conditions hereinafter set forth be, and the same is hereby, authorized and approved. The principal terms, provisions, and conditions upon which the leasing of said tract or parcel of land to said Council is herein and hereby authorized and approved are as follows: (1) Said leasing shall be subject to. the rights of the Urbana-Champaign Sanitary District in a portion of said property under an easement grant heretofore given said District, and shall also be subject to an easement of passageway over and across a strip twenty feet wide extending from the west line to the east line of said premises and located north of the building to be erected by the Council which shall be reserved to University and its licensees in the lease for the entire term of the latter. (2) The term of the lease shall be for seventy-five years from April I, 1959, unless sooner terminated by virtue of the operation of its provisions. (3) The Council shall construct, at its own expense, upon said premises, as soon as reasonably possible after the execution of the lease, its contemplated building which shall be constructed in accordance with plans and specifications approved by the University and so as to conform to the University's standards of construction and with all applicable state laws. (4) Title to said building, when constructed, shall vest in the University and shall continue to be held by the University upon the termination or expiration of the lease. (5) No alterations to said building shall be made or any additions thereto shall be constructed by the Council, nor shall it construct any additional building or buildings upon said premises, without first securing University's approval in writing for the making or construction of the same, and the provisions of (3) and (4) above shall apply to any such alterations or additional construction. (6) The Council shall, at its expense, maintain and keep the demised premises, all structures built by it thereon, and the above mentioned passageway in good repair and safe condition throughout the duration of the lease. (7) Council shall pay any taxes legally assessed against said premises and any structures erected by Council thereon or against Council's leasehold interest therein, but shall have the right to contest, at its expense, the legality and validity of any assessment of taxes against the same before paying the same. (8) The Council shall provide, construct, and maintain, at its expense, a suitable fence along all except the north and west lines of said demised premises, and gates at the east end of the above mentioned strip, as long as desired by University during the duration of the lease. (9) The Council shall indemnify the University and save it harmless from liability, loss, damage, or expense arising from injury sustained to the person or property of any person on or about said premises during the duration of the lease, and shall have the right to defend, at Council's expense, each and every claim asserted against University or suit instituted against the latter for which Council may thus become liable. (10) In view of the foregoing undertakings to be assumed by Council, and the other benefits which University will derive from said lease and the activities conducted by Council upon said premises, the rent to be paid by Council for the premises during the duration of the lease shall be One Dollar per year.
