Said conveyance shall be made by said Comptroller and Secretary upon receipt from the Athletic Association of the University of Illinois, of a duly authorized conveyance warranting and conveying to this public corporation, its successors and assigns, for the benefit of this public corporation, its successors and assigns, and the general public at large, an easement and right of way for the free, unobstructed passage of aircraft, by whomsoever owned or operated, in and through the air space over and across the property bounded and described as follows: The Southeast Quarter ( S E }4) of Section Two (2) in Township Eighteen North ( T 18 N ) , Range Eight East ( R 8 E ) of the Third Principal Meridian (3rd P.M.) in the County of Champaign, and State of Illinois; provided, however, that the air space in which said easement and right of way is granted shall be that which lies above the following heights: Seven Hundred Sixty-Seven feet (767') Mean Sea Level elevation and above, over and across the following described tract of land: The West ( W ) Twelve Hundred feet (1200') of the North ( N ) Twelve Hundred feet (1200') of the Southeast Quarter ( S E 54) of Section Two (2) in Township Eighteen N o r t h ( T 18 N ) , Range Eight East ( R 8 E ) of the Third Principal Meridian (3rd P.M.) in the County of Champaign and State of Illinois, hereinafter referred to as "Tract O n e ; " and Seven Hundred Ninety-Four feet (794') Mean Sea Level elevation and above, over and across the following described tract of land: The West One-Half (W 1 /^) of the Southeast Quarter ( S E %) of Section Two (2) except the West ( W ) Twelve Hundred feet (1200') of the North ( N ) Twelve Hundred feet (1200') of said Section T w o (2) all in Township Eighteen North ( T 18 N ) , Range Eight East ( R 8 E ) of the Third Principal Meridian (3rd P.M.) in the County of Champaign and State of Illinois, hereinafter referred to as "Tract T w o " ; and Eight Hundred Nineteen feet (819') Mean Sea Level elevation and above, over and across the following described tract of land: The East One-Half ( E j 4 ) of the Southeast Quarter ( S E %.) of Section Two (2) in Township Eighteen North ( T 18 N ) , Range Eight East ( R 8 E ) , of the Third Principal Meridian (3rd P.M.) in the County of Champaign and State of Illinois, hereinafter referred to as "Tract Three;" [The Northeast end of Northeast-Southwest Runway 22, University of Illinois Airport, is Seven Hundred Forty-Four feet (744') Mean Sea Level elevation and, therefore, the aforesaid heights are Twenty-Three feet (23') over Tract One, Fifty feet (50') over Tract Two, and Seventy-Five feet (75') over Tract Three, higher than the Northeast end of said runway.] and provided further that said conveyance shall contain covenants that the Athletic Association of the University of Illinois, its successors and assigns, shall not hereafter construct or permit or suffer to remain upon said lands any obstruction that extends above the heights aforesaid; and that the Athletic Association of the University of Illinois, its successors and assigns, shall not hereafter use or permit or suffer use of the above-described lands in such a manner as to create electrical interference with radio communication between the installation upon the University of Illinois Airport and aircraft, or as to make it difficult for fliers to distinguish between airport lights and others, or as to result in glare in the eyes of fliers using the said airport, or as to impair visibility in the vicinity of the airport, or as otherwise to endanger the landing, taking off, or maneuvering of aircraft. T h e aforesaid covenants and conditions imposed shall be binding upon the Athletic Association of the University of Illinois, its successors and assigns, and shall run with the lands of the Athletic Association of the University of Illinois, as hereinabove described, for the benefit of this public corporation, and its successors and assigns in the ownership and operation of the aforesaid University of Illinois Airport until said Airport shall be abandoned and shall cease to be used for airport purposes.
