of officers of the Athletic Association, an area of eight acres in the northeast corner of the present golf course would interfere the least with the development of another golf course since this area is now used as a practice fairway. Title to this property is in the University of Illinois. I t is therefore proposed that the University transfer approximately eight acres of land described below to the University of Illinois Athletic Association in consideration for the air rights over the property to be acquired from Mr. Howard, and with the understanding that the Athletic Association will develop on the land it acquires from Mr. H o w a r d an eighteen-hole golf course in use of which some preference will be given to University students and faculty as indicated above. Resolution Be It and It Hereby Is Resolved by this Board of Trustees of the Board of Trustees of the University of Illinois, a public corporation of the State of Illinois, with its principal office in the City of Urbana, in the County of Champaign, and State of Illinois, that the Comptroller and Secretary of this public corporation be, and they hereby are, authorized and directed, to execute, acknowledge, and deliver, in the name and in behalf of, this public corporation, and under its corporate seal, a W a r r a n t y Deed and such other documents in connection therewith as said Comptroller and Secretary may deem necessary or desirable in order to convey to the Athletic Association of the University of Illinois, a not-for-profit corporation of the State of Illinois, with its principal office in the City of Champaign, in the County of Champaign, and State of Illinois, all right, title, and interest in and to the following described property except that air rights shall be retained for the benefit of this public corporation, its successors and assigns, and the general public at large, for the free, unobstructed passage of aircraft, by whomsoever owned or operated, in and through the air space over and across the following described property, Eight Hundred and Nineteen feet (819') Mean Sea Level, and above, [The Northeast end of Northeast-Southwest Runway 22, University of Illinois Airport, is Seven Hundred Forty-Four feet (744') Mean Sea Level elevation and therefore air rights will be retained in the air space over said property which is seventy-five feet or more than seventy-five feet higher than the elevation of the Northeast end of Northeast-Southwest runway 22] ; and provided that the Athletic Association of the University of Illinois, Grantee, its successors and assigns, shall be prohibited from constructing, permitting, or suffering to remain upon said lands any obstruction that extends above the heights aforesaid and that Grantee, its successors and assigns shall not hereafter use or permit or suffer use of the following described property in such a manner as to create electrical interference with radio communication between the installation upon the University of Illinois Airport and aircraft or as to make it difficult for fliers to distinguish between airport lights and others, or as to result in glare in the eyes of fliers using the said airport, or as to impair visibility in the vicinity of the airport, or as otherwise to endanger the landing, taking off, or maneuvering of aircraft; to-wit: Beginning at a stone at the Northeast (N.E.) corner of Section Two (2), in Township Eighteen North ( T 18 N ) , Range Eight East ( R 8 E ) of the Third Principal Meridian (3rd P . M . ) , thence South 0° oo'W 33.00 feet along the East line of said Section to the true point of beginning; thence South 0° oo'W 845.11 feet along the East line of said Section Two (2) ; thence N o r t h 00° oo'W 150 feet; thence North 31° 05' 15" W 378.49 feet; thence North 00° oo'W 173.00 feet; thence North 42° 14' 20" W 291.59 feet; thence North 1° 02'E 141.68 feet; to a point 33 feet South of the North line of said Section T w o (2) ; thence S 88° 59' 00" E 538.97 feet along a line parallel to the North line of said Section Two (2) to the East line of said Section T w o ( 2 ) , the true point of beginning, situated in the County of Champaign and State of Illinois.
