Whereas, damages or penalties are not provided for either in the specifications or the contract; and Whereas, the Owner through its proper representatives has made a study of the facts relating to the delay in the completion of such contract by the Contractor and has given consideration to its rights and privileges under such contract and to the Contractor's duties and responsibilities thereunder in the light of the applicable l a w ; Now, therefore, be it resolved by the Board of Trustees of the University of Illinois as follows: (1) That it has been satisfactorily determined that the cause for the Contractor's failure to complete the contract on the contract completion date and the delay in the completion of his contract are properly specified in the preamble of this resolution; (2) That it is hereby determined that the Owner has not suffered and will not suffer any actual damages, either direct or indirect, by reason of the Contractor's failure to complete said contract on or before the contract completion date and that the completion of such contract on or before the thirty-first day of January, 1040, will not damage or injure the Owner in any m a n n e r ; (3) That the Contractor's completion of said contract on or before the 31st day of January, 1940, is otherwise approved; (4) T h a t the certified copies of this resolution be forwarded by the recording officer to the Public W o r k s Administration.

P O W E R PLANT CONTRACT C H A N G E ORDER

(19) T h e Director of the Physical Plant Department recommends approval of a change in the contract with the Marquette Electric Switchboard Company for the installation of switching equipment in the new power plant, as follows: Additions to the 600-volt switching equipment as covered by Items 6, 7, 8, 10, 11, 13, and 15 of Sargent & Lundy's specifications, December 20, 1939, Items 6 and 7 revised January 10, 1940. (As per quotation dated January 15, 1940). Total additions, $1,070.80. At the time specifications were prepared the load on the equipment was not known and could not be specified. T h e Department does not consider it practicable to take separate bids as the equipment will have to be erected in the shop and mounted in the switchgear and cubicles furnished under the Marquette Electric Switchboard Company's contract. O n m o t i o n of M r . K a r r a k e r , t h i s c h a n g e w a s a p p r o v e d . CONTRACT CHANGE ORDERS ON P.W.A. PROJECTS (20) In accordance with the authorization of the Board of Trustees, I have approved the following contract change orders and request confirmation of such approval: Illini Union Building Change Order No. 3, contract with the Arthur W. Murray Company for Plumbing Work. This order is to cover rearrangement of refrigerator drains, machinery room drains and installation of additional cleanouts in storm water sewer installed under another contract—Add £397 67 Change Order No. 4, contract with the Arthur W. Murray Company for Plumbing Work. (1) Provision of additional manhole north of building— Add $212 45 (2) For handling of additional earth in trenches in basement—Add 255 58 Total $468 03 (3) Omission of gas lines to fireplaces—Deduct 209 32 Net Addition $258 7'
