Three alternates were specified: (1) omission of concrete barriers and fills— Library site; (2) omission of grading and planting—Library site; (3) omission of lawn operations on all three sites. Bids were received from: (1) Sylvester Koval, 2359 Lee Road, Cleveland Heights, O h i o ; (2) Hubert Hunsucker, 406 North Prairie Street, Champaign, Illinois; (3) Hillsdale Landscape Company, Rural Route 13, Box 158, Indianapolis, Indiana. The amount of funds budgeted for this purpose was $7,000, whereas the lowest base bid was $10,765. T h e total of the three alternates quoted by the lowest bidder exceeds the amount of his base bid by approximately $500. This was discussed with him, and it is obvious that he made an error in estimating. In view of these circumstances the Physical Plant Department recommends the rejection of all bids and that it be authorized to obtain new ones along with bids for landscaping of the Illini Union Building site ( P . W . A . Project 111. 1745-F). This will not cause any delay in completion of the work as it cannot be done before early spring. Moreover, it is anticipated that better prices will be secured if all landscaping bids are taken at the same time, due to greater amount of work involved. O n m o t i o n of M r . M o s c h e l , t h i s r e c o m m e n d a t i o n w a s a d o p t e d . A t this point, President M a y e r arrived a n d took the chair. LICENSE TO ILLINOIS IOWA POWER COMPANY FOR GAS LINE (5) The Illinois Iowa Power Company has submitted a petition for a right and easement for a gas transmission and distribution line on Pennsylvania Avenue from Fourth Street to Lincoln Avenue. This is necessary for providing gas service to the future expansion of the campus southward. The Physical Plant Department recommends approval of this request. The University Counsel advises that it has been uniformly held that the University is without power to grant the right to a utility to "trespass on the grounds of the University," and that the latter has no "authority to grant any franchises or right of ways in or over" lands of the University. However, the Board of Trustees may properly grant a license to the Illinois Iowa Power Company revocable when, in the judgment of the Board, the University's interests so require. A resolution granting such license is offered herewith. O n m o t i o n of M r . M o s c h e l , t h e f o l l o w i n g r e s o l u t i o n w a s a d o p t e d . RESOLUTION Whereas, Illinois Iowa Power Company, a corporation, has applied to the Board of Trustees of the University of Illinois for a license to construct, operate, and maintain a gas transmission and distribution line at the locations described in said petition in order to comply with the request from the University of Illinois for the furnishing of gas to serve its Natural Resources Building now nearing completion and in order to meet future needs of the University of Illinois in and about the south campus district and in order to augment present service in and about the faculty district of the City of U r b a n a ; Now, therefore, be it resolved, that the Board of Trustees of the University of Illinois (hereinafter sometimes called licensor) hereby grants a license to Illinois Iowa Power Company, its successors, licensees, and assigns (hereinafter sometimes called licensee) to construct, maintain, and operate a gas transmission and distribution line as follows: Commencing at a point in licensee's existing high-pressure gas line at the intersection of Maple Avenue and F o u r t h Street and extending thence eastwardly along and upon said Maple Avenue and along and upon Pennsylvania Avenue in the City of Urbana to the intersection of said Pennsylvania Avenue and Lincoln Avenue in said City of U r b a n a ; also a lateral line extending northwardly a distance of 300 feet more or less along and upon the southerly extension of Sixth Street from its intersection with said Maple Avenue. This license includes the right, privilege, and authority to construct, operate, and maintain such gas transmission and distribution line at the location herein set forth including all facilities and equipment appurtenant thereto or used in
