Litigation Relating to Rice Foundation

(30) T h e university counsel gave a brief summary of the various pending cases which relate to the entitlement of the University and four other medical institutions (Northwestern University, Loyola University of Chicago, Rush-PresbyterianSt. Luke's Medical Center, and Michael Reese Hospital and Medical Center) to control and direct the activities of the Rice Foundation, which is a major beneficiary of the estates of Daniel F. Rice and Ada L. Rice. The University and other medical institutions are the defendants in one suit filed in the Circuit Court of Cook County, Illinois (Case No. 77 C H 8803) by a group of individuals contesting the medical institutions' right to control the Rice Foundation. Special counsel for the University in this matter has informed the medical institutions that the judge presently assigned to this matter is a former client of the plaintiffs' attorneys and has recommended that a motion for change of venue from that judge be presented. Mr. Costello stated that he supported special counsel's recommendation and that the University would proceed to file the motion for change of venue unless the Board of Trustees directed otherwise. No dissent was expressed by the members of the board to the proposed filing of the motion. T h e r e b e i n g n o f u r t h e r business, t h e b o a r d a d j o u r n e d .
