The above information was obtained from Dean Mumford under date of September 5. I enclose his recommendation of August 30, to give the Urbana Laboratories therightto sell this test material and I concur in his recommendation on the basis of the information received September 5 as to cost and selling price. I there/ore recommend that the Urbana Laboratories be granted permission to make this solution under such supervision as Professor Burlison feels is necessary to insure its being strictly in accordance with the formula, and that they be permitted to advertise and sell the product at the proposed prices; this privilege to be granted without royalty to the University until November 1, 1929, at the end of which period the question of the payment of a royalty shall be reviewed. The University reserves the right of withdrawing this privilege upon thirty days' notice, after November 1, 1929. I further recommend that the Urbana Laboratories be required to keep records of their sales so that they may be examined by the University at any time. This provision is desirable so that we m a y obtain information as to the terms under which patent rights should be granted. Yours very truly,

On motion of Mrs. Evans, this recommendation was concurred in. REQUEST OF GENERAL TALKING PICTURES CORPORATION ON INFRINGEMENT OF KUNZ PATENT

(34) A request of the General Talking Pictures Corporation, apparently successor to the DeForest Phonofilms, for permission to bring suit against certain people who are infringing the Kunz patent. The contract between the University and the DeForest Phonofilms Company provides that the Company shall bring suit but must first obtain permission from the University. O n motion of M r . Barr, this matter w a s referred to the President of the University, with p o w e r to act after conference with the Legal Counsel.

REPORT ON EXTENSION OF HART LOAN

(35) The Acting Comptroller, Mr. H. M . Edwards, under date of September 9, reports as follows: September 9, 1929 President David Kinley, jjj Administration Building Dear President Kinley: I desire to report that in accordance with the action of the Board of Trustees under date of July 17, 1929, an extension agreement on the loan of $15,000 to Mr. M . M . Hart of Benton, Illinois, has been completed and delivered to the TrevettMattis Banking Company. The extension is forfiveyears from July 16, 1929, and the agreement which was signed by Mr. M . M . Hart and Judge W . H. Hart provides: (1) That $500 of the principal (with interest) be paid by August 15, 1929; (2) That $500 of the principal be paid yearly, besides the interest, to be paid by the last interest date of each year. (3) That $2,500 in addition to the $500 annual payment, and in addition to interest be paid on the principal on or before December 15, 1932. I would report further that a payment of $500 with interest due August 15, 1929, has been received. Cordially yours,
