DEAR PRESIDENT KINLEY:

In reply to your inquiry of October 29th as to whether students who have General Assembly scholarships are entitled to exemption fees in the School of Music, I am pleased to give you the following OPINION: A decision of the question depends entirely upon the construction of the first half of Section 174 of the Free School Act of 1909, as amended by act approved May 13, 1919, which reads as follows: "Any University Scholarship issued under the provisions of this Act shall exempt the holder from the payment of tuition, or any matriculation, term, or incidental fee whatsoever, except for purchase of laboratory supplies and similar fees for supplies and materials." The practise of collecting tuition and incidental fees from scholarship holders who took music obtained, I suppose, upon the theory that the School of Music is a professional school. Prior to the amendment of 1919, the privileges of these scholarships and the county scholarships were not available in the professional schools and colleges. By the amendment, however, it is evident that the General Assembly intended to extend the privilege to the professional schools. The practise of collecting from holders of scholarships, tuition and incidental fees for instruction in the School of Music, therefore, should be discontinued. I may say, however, that it would be entirely legitimate to charge such students for the rent of musical instruments and the sheet music or material used, provided such charges are made against other students. On motion of Mr. Trimble, the Comptroller was authorized to refund the fees which has been charged improperly for the current semester against holders of scholarships in the School of Music.

PROPOSAL TO PURCHASE AND HOLD LAND (26) A request for consideration of the offer of the Champaign Chamber of Commerce to purchase and to hold for the University such land in Champaign as the Trustees should declare to be necessary to provide for the growth of the campus (page 585).

On motion of Mr. Ward, this matter was referred to the Finance Committee for investigation and report.

TERMS OF 1LLINI CONTRACT (27) A recommendation from the Comptroller that the terms of the contract for printing the Daily Illini (page 606) be modified by the insertion of a provision for the termination of the contract by either party on 30 days notice.

On motion of Mr. Trimble, this modification was authorized.
