PROCEEDINGS OP THE BOAED OF TRUSTEES. L I N E FENCE ON THE SOUTH FARM.

Pursuant to authority given by the Board of Trustees (sSe pp. 47 & and 476 of the minutes of the meeting of June 8, 1908), arrangement was made with Mr. William Sullivan for a determination of the disputed line by arbitration. A letter from Judge Harker, a copy of the agreement, and a copy of the finding of the surveyor are given below. This agreement, and the finding with plat attached, was filed in theoffice of the Eecorder of Champaign county, Nov. 21, 1908, and isrecorded in Book 10 of Miscellaneous Eecords, p. 588. The secretary was directed, on motion of Mr. Davison, to file the recorded agreement and plat.

UNIVERSITY OF ILLINOIS, Dec. 4, 1908.

To the Board of Trustees of the University of Illinois: GENTLEMEN—Respecting the controversy between the College of Agriculture and William Sullivan over the boundary line between the S. E. % of the N. E. % of section 19, township 19 N., R. 9 E., owned by the University, and the N. E. " 4 of the S. E. % of said section, referred to me by the Board of * Trustees some time ago, I beg leave to submit the following report: No agreement fixing a line between the two tracts of land could be reached with Mr. Sullivan because of his insistance that a line fixed by a survey of the Champaign county surveyor a few years ago was the correct boundary line. That survey differed from one made by Mr. L. G-. Parker under direction of Professor Baker, and took from the University a strip nine feet in width across the entire forty acre tract belonging to it. Mr. Sullivan then employed Ray and Dobbins, lawyers of Champaign, to represent him, and a conference with Mr. Dobbins resulted in the selection of Charles Cottingham, civil engineer of Danville, Illinois, to survey the two tracts of land and establish the true lines and corners between them. A written agreement was drafted and subsequently signed by Mr. Abbott as president of the Board of Trustees and by Mr. Sullivan. Cottingham then made the survey, established the lines and corners between the two tracts and made a- plat thereof, as provided by law. The agreement, plat and surveyor's report were under my direction as counsel for the University, recorded in the recorder's office of Champaign county. The proceeding was had under .a recent act of the Legislature and permanently fixes the line and corners between the two tracts. I am glad to be able to report to you that the contention of the University made through Professor Baker and Mr. Parker was fully sustained by the work of Mr. Cottingham. I submit with the report the written agreement of the parties and the plat and report of Mr. Cottingham, with the suggestion that they be carefully preserved. Respectfully submitted,

* AGREEMENT.

WHEREAS, A dispute exists between the Board of Trustees of the University of Illinois, the owner of the southeast quarter of the northeast quartet of section nineteen (19), township nineteen (19) north, range nine (9) east, Champaign county, Illinois, and William Sullivan, the owner of the northeast quarter of the southeast quarter of said section as to the boundary line between the said tracts of land; and WHEREAS, The said parties desire to establish permanently* the lines and corners between said tracts of land.
