T H I S INDENTURE made this 20th day of May, 1909, between t h e Board of T r u s t e e s of t h e University of Illinois, for a n d in behalf of t h e University of Illinois, of t h e first p a r t , hereinafter referred to a s Trustees, a n d t h e Urbana a n d Champaign Railway, Gas a n d Electric Company, p a r t y of t h e second part, hereinafter referred to as Company. WITNESSETH, T h a t in consideration of t h e a g r e e m e n t of t h e Company herein contained, t h e Trustees hereby g r a n t to t h e Company permission to construct, m a i n t a i n a n d operate a n additional t r a c k on t h e campus of t h e University, between Mathews a n d B u r rill avenues, on t h e c o n t i n u a t i o n of the 40-foot right-of-way in Urbana, a n d a curve from t h e p r e s e n t t r a c k s o u t h w a r d on W r i g h t street of not to exceed a 75 foot r a d i u s . T h e t w o t r a c k s shall be twelve a n d thirty-three one-hundredths (12.33) feet, center to center, a n d equidistant from a line joining t h e centers of t h e rights-ofway on t h e opposite side of t h e campus. In consideration of t h e permission to construct, m a i n t a i n a n d operate a n electric r a i l w a y across t h e University campus g r a n t e d by t h e T r u s t e e s to the Company, t h e Company agrees, in constructing t h e r a i l w a y to be guided by specifications to be approved by t h e supervising architect of t h e University, respecting location, g r a d e or grades, k i n d of rails, trolley poles, etc. The Company will also, a t i t s own expense, m a k e all changes in a n d r e p a i r s to walks, drives, t u n n e l s , sewers, pipes, etc., necessitated by t h e construction work. T h e Company further, a t its own expense, will grade t h e approaches to its t r a c k across said campus on either side so as to afford a n easy slope on either side t o said t r a c k s a n d facilitate crossing t h e same, in accordance with specifications a n d directions furnished by t h e University, a n d in t h e event t h a t t h e g r a d e of said campus shall hereafter be changed by said University, said Company agrees to m a k e t h e changes in t h e g r a d e of its t r a c k necessary to conform to such altered g r a d e of said campus. The permission hereby g r a n t e d t h e Company to cross t h e campus with its t r a c k does n o t constitute a n easement or exclusive" r i g h t to t h e land so occupied, a n d a l t h o u g h t h e Company agrees to gravel or sod, as required, the space between t h e rails, a n d for a distance of t h r e e (3) feet on either side thereof, t h e T r u s t e e s do n o t waive t h e i r police or <3ther jurisdiction over t h i s s t r i p of land. The Company further agrees t h a t t h e additional t r a c k is laid subject to the conditions n a m e d in t h e a g r e e m e n t of 1903, with reference to i t s easem e n t over t h e same t r a c t of land. The Company further agrees to secure permission from t h e University before a t a n y t i m e beginning reconstruction w o r k on t h e t r a c k s a t this, crossing of t h e campus. I N W I T N E S S WHEREOF, t h e p a r t i e s hereto have h e r e u n t o set t h e i r h a n d s and seals t h e day a n d date first above w r i t t e n .
