CONTRACT, NATURAL H I S T O R Y

BUILDING.

A communication from Professor White, supervising architect, was received stating that some credits should be taken into consideration which would reduce the amount of the heating contract for the Natural History building from $7,793.60, as stated on page 128 of the minutes of the meeting of March 31, to $7,672.60.

SECOND T R A C K ON O L D KIGHT-OF-WAY.

Mr. Abbott reported t h a t pursuant to instructions given at the meeting of the board of March 31, he had conferred with Judge Harker, and also with the officers of the Illinois Traction System, and t h a t as the' result of this conference the work would not be carried on. to completion across the University grounds until a further agreement was had between the University and the railway company. H e also presented the following communications from J u d g e Harker and Mr. George M. Mattis, vicepresident of the Illinois Traction System which were received for record:

URBANA, IEL., April 27, 1909.

To the Board of Trustees of the University of Illinois: In obedience to your direction of March 31, 1909, I have investigated the matter of the Urbana and Champaign Railway, Gas and Electric Company laying an additional track across the campus on the old right of way, and beg leave to make the following report: I find that in compromise of . pending litigation between the company and the University, the company, in December, 1903, conveyed and quitclaimed to the University all its interest in the "strip of ground known as the old right of way of the street railway company, forty feet wide and extending from Wright street in Champaign east to what is known as Nelson or Mathews avenue in Urbana,'' and that the Board of Trustees of the University by resolution at its December meeting, 1903, granted to the company permission to lay a track and operate its cars over such strip of land. The grant was made subject to the option of the University to require the company to vacate the premises if desired for building purposes and was limited until a time when the city of Urbana should grant a franchise to the company to operate its line on certain parts of Mathews and Springfield avenues. On investigation I find that the company has been doing considerable excavating on the strip of ground in question with a view of laying a second track. In a conference with Mr. W. B. McKInley, representing the road, I insisted that the right to lay a track did not give them the right to lay two tracks and that a continuation of the work was without any authority from the Board of Trustees. He stated that the operation of two tracks over the strip was necessary, in view of the proposed taking up of the track
