T h e Secretary reported that, pursuant to instructions given by the B o a r d at the meeting of September 12, 1905, he sent to the Attorney General the papers submitted to the Board in case of E r i c J. Everett, asking his opinion thereon, and in reply reecived the following letter:

STATE OF ILLINOIS, OFFICE OF ATTORNEY GENERAL,

SPRINGFIELD, October 12, 1905.

Mr. W. L. Pillsbury, Secretary Board of Trustees, University of Illinois, Urbana, Illinois. DEAR SIR—I beg to acknowledge receipt of your favor of the 11th inst. in regard * to "An Act to regulate the profession of public accountants,'' approved May 15, 1903. You ask for a construction of Section 3 of said Act, commonly referred to as the "Waiver Clause." This section reads as follows: "The University of Illinois may, in tljeir discretion, under regulations provided by their rules, waive all or any part of the examination of any applicant possessing the qualifications mentioned in Section 1, who shall have had five successive years' previous experience as a public accountant previous to the date of application, who shall apply in writing within one year after the passage of this Act and who shall have been practicing in this State as a public accountant on his own account for a period not less than one year next prior/to the passage of this Act; also to any person who shall have been actively in practice as a public accountant for not less than five years next prior to the passage of this Act outside of the State of Illinois, who shall have passed an examination equivalent, in the opinon of the University of Illinois, to the examination to be held under the provisions of this Act." The University of Illinois, pursuant to said Act, has established a -University Committee on Accountancy. This Committee on Accountancy has adopted certain rules and regulations as to the conduct of examinations of candidates for certificates as certified public accountants and for issuing such certificates to persons coming within said Section 3 of said Act. These rules and regulations, so far as they relate to candidates for such certificates under said Section 3, are as follows: Rule 7. "This Committee shall also examine the ,papers of applicants under Section 3 of the law and shall certify to the President the names of those who are eligible under the section to receive the degree of certified public accountant." Applications. Rule 1. "Applicants for the degree of C. P. A. on the basis of previous' practice, under section 3 of the law, shall file their applications with the University Committee on Accountancy, together with a sworn statement setting forth their age, legal residence, the length of time during which they have practiced, the place where such practice was had, and the time, place, and scope of examinations, if any, passed in accountancy." Rule 3. "Applicants for examinations, or for the degree under section 3 of the law, shall send a fee of $25, payable to the University, in accordance with section 4 of the Act." Examinations. Rule 11. "The applications and credentials of applicants for the degree of C. P. A. on the basis of previous experience, under section 3 of the law, shall be examined by the board of examiners.
