URBANA, June' 7, 1898.

To the Board of Trustees of the University of Illinois. GENTLEMEN :—I beg leave to state that Busse & Gleason brought suit against the University of Illinois, and S. W. Shattuck, as Business Manager, for an alleged balance due as sub-contractors on the Library. Service was had upon myself, and then at the reguest of President McKay, I took charge of the case and filed a demurrer raising the question whether or not the University of Illinois could be sued. The court overruled the demurrer and directed me to answer, which I did by plea. Trial was had, and on the evidence of young Gleason, the court dismissed the action as against S. W. Shattuck, and gave judgment against the University of Illinois. The judgment was for $486.85 and costs. I prayed an appeal which was allowed, bond to be filed and bill of exceptions within thirty days from May 13, 1898. I deem it important to the University of Illinois to have the question settled whether or not an action will lie against this institution. Respectfully submitted,

THOMAS J. SMITH.

After instruct amount pay the
