struction is of value only where there is doubt and uncertainty, and there is none in this instance. All that has been done is that the General Assembly and public officials have disregarded constitutional requirements adopted by the people for their protection. It cannot be said that the people, who constitute the other party in interest, have acquiesced in the construction adopted by the General Assembly, since the money interest of an individual taxpayer would not justify the necessary expense of an appeal to the courts to prevent such unlawful action. I t would not be practicable to enumerate the appropriations held void by t h e chancellor and to explain in detail their nature. Each one was for the payment of a claim created without express authority of law and either without a previous appropriation or in excess of the appropriation." See also People ex rel. Lucey v. Turney, 273 111. 546, and Whittemore v. People, 227 id. 453The Attorney General was in error in assuming that he was the sole legal representative of the University of Illinois, or its trustees. H e was also in error in appearing in the case described in the petition, pending in the circuit court of Cook county, as attorney for the university and the other defendants therein named. T h e writ of mandamus is awarded directing the Attorney General to withdraw his appearance and all pleadings filed by him in the case of People of the State of Illinois ex rel. etc., v. University of Illinois et al., general number 42C11035, being an action at law on the docket of the circuit court of Cook county. In all other respects the prayer of the petition is denied.
