BOARD OF TRUSTEES

[September 16

EXECUTIVE SESSION President Paul Stone, referring to Section T w o of the O p e n Meetings Act, stated: "A motion is now in order to hold an executive session to consider information regarding the appointment, employment, or dismissal of employees or officers, and to discuss pending, probable, or imminent litigation against or on behalf of the University, and to discuss the acquisition of real property." T h e motion was m a d e by Miss Forsyth and approved unanimously. Following a brief meeting of die president with the trustees, the board, with the general officers in attendance, conducted the following business in executive session. Litigation Initiated by Raymond Barbosa (1) A complaint in Administrative Review has been filed in the Circuit Court of Cook County (Case # 8 2 L 7653) by Raymond Barbosa seeking reversal of a decision of the Committee on Accountancy denying him an Illinois certified public accountant's certificate and requesting an order that such certificate be issued. T h e defendants are the Committee on Accountancy, Kenneth R. Perry, Richard L. Kaplan, Belverd E. Needles, Jr., Edwin Cohn, and Gary R. Engelgau, individually and as members of the committee. T h e plaintiff had written the several sections of the certified public accountant examination in New York at various times and then sought to transfer the New York credits in fulfillment of the requirements for the Illinois certificate. T h e Committee on Accountancy determined that under the rules previously adopted by the board, the New York credits were not transferable since the applicant had not been required to write all sections of the New York certified public accountant's examination when he initially took it. Applicants who write examinations in Illinois are required to take all sections at the initial writing of the test. Pursuant to previous delegations by the Board of Trustees, the university counsel has been given interim authorization to take such steps as are necessary or appropriate, including the employment of special counsel, to protect the interest of the University in this matter. H e has recommended that such authorization be ratified and confirmed in all respects. I concur. O n motion of Mr. Howard, this recommendation was approved by the following vote: Aye, Mrs. Day, Dr. Donoghue, Mr. Forsyth, M r . Harm, M r . Howard, Mr. M a d d e n , M r . Neal, Mrs. Shepherd, M r . Stone; no, n o n e ; absent, Governor Thompson. ( T h e student advisory vote was: Aye, M r . Bandala, M r . Cobb, Miss Forsyth; no, none.) ( M r . Bernard T. Wall, treasurer of the board, left the room when this item was considered, since M r . Barbosa is a member of his law firm.) Litigation Initiated by Jensen Corporation (2) A petition for Writ of Mandamus has been filed in the Circuit Court of Cook County (Case #82-L-5025 A) by Jensen Corporation seeking a court order directing the Board of Trustees to rescind the award of a contract to Allied Mechanical Industries and to award the contract to Jensen Corporation.
