The student advisory vote was: Aye, Miss Conlon, Mr. Overstreet; no, none; absent, Miss Winter. On motion of Mr. Livingston, authority was given as recommended by the following vote: Aye, Mr. Forsyth, Mr. Hahn, Mr. Howard, Mr. Livingston, Mr. Neal, Mrs. Rader, Mrs. Shepherd, Mr. Velasquez; no, none; absent, Mr. Lenz, Governor Thompson.

Litigation Related to Krannert Center for the Performing Arts, Urbana

(50) At its meeting on February 20, 1974, the Board of Trustees authorized the initiation of litigation to recover damages for design and construction deficiencies in connection with the building of the Krannert Center for the Performing Arts at the Urbana-Champaign campus. In February 1977 the Circuit Court of Champaign County entered an order that all discovery in the matter was to be completed by September of this year (subsequently extended to October), and that the trial on the merits was to begin in February 1978 and be completed no later than May 1978. There have been numerous hearings on motions and amendments to pleadings, and counterclaims and third-party complaints have been filed. Discovery has been extensive, and depositions have been scheduled throughout the summer on almost a daily basis. From time to time the prospect of settlement of the litigation has been examined and discussed, with no definitive results to date. As the matter progresses on the timetable established by the court, and discovery becomes more complete, the potential for a mutually acceptable settlement arrangement is likely to increase. In view of the fact that the board has no meeting scheduled during the month of August 1977, the university counsel has recommended that the board confirm the authority of the Executive Committee of the board to consider and act upon any proposed settlement of the litigation in the event that such action is necessary or desirable prior to the next meeting of the board. I concur.

On motion of Mr. Livingston, the authority of the Executive Committee was confirmed by the following vote: Aye, Mr. Forsyth, Mr. Hahn, Mr. Howard, Mr. Livingston, Mr. Neal, Mrs. Rader, Mrs. Shepherd, Mr. Velasquez; no, none; absent, Mr. Lenz, Governor Thompson. There being no further business, the board adjourned.
