They have requested authority to submit an offer of settlement to the government upon this basis, if necessary, and have pointed out that the amount of the reduction of the University's claim contemplated by such a settlement would not exceed the cost to the University of trying the suit in an effort to secure the full amount of its claim. They have also stated that, if such a settlement is effected, they will reduce the amount of their contingent fee from 25 per cent to 20 per cent of the amount recovered upon the disputed portion of the University's claim. While they and the University Legal Counsel believe that litigation of the University's claim will probably result in its allowance in full, it must be conceded that this result can not be said to be certain, and, for this reason and the foregoing considerations, the Comptroller and the Legal Counsel recommend that they be authorized to make a compromise settlement of the suit and claim, through a reduction in the latter of not more than 15 per cent of the disputed portion thereof, and to instruct the University's attorneys to attempt to so dispose of the suit.
