S E T T L E M E N T WITH AMERICAN CASUALTY COMPANY UNDER C O N T R A C T P E R F O R M A N C E BOND O F BDN S T E E L ERECTING COMPANY The Legal Counsel presented the following report. At its January 21, 1953, meeting, the Board of Trustees declared BDN Steel Erecting Company in default with respect to its contract for the erection of a steel radio tower with antenna and other equipment at Robert Allerton Park, Illinois, and authorized the Comptroller and Legal Counsel to take steps to enforce the University's rights under the performance bond given by BDN Steel Erecting Company, as principal, and American Casualty Company of Reading, Pennsylvania, as surety, as a result of the principal's default. The amount of that bond was $12,600. Shortly after B D N Steel Erecting Company began work under the contract, it was paid $2,000 on account by the University. This was done without giving notice to the surety company and securing its consent to the payment, and the surety company contends that it was prejudiced by this action and that this payment either released it entirely from its liability under the bond or reduced that liability to the extent of the payment. Subsequently, and with the surety's consent, the University paid the contractor an additional $5,862.96 for work done by it under the contract. Negotiations with the attorney for the surety company have resulted in an assurance by him that he will recommend that the surety company pay the University $10,600 in full settlement and satisfaction of the surety's liability to the
