SETTLEMENT OF CLAIM AGAINST ARMY NUTRITION LABORATORY UNDER CONTRACT N O . W - 4 9 - 0 0 7 - M D - 3 8 8 (16) On February 23, 1953, the Board of Trustees was informed that the University had instituted a suit in the United States Court of Claims for the balance it claimed was due it under a contract entered into in 1947 with the Office of the Surgeon General of the United States for research work in the Research and Educational Hospitals. The contract included provision for the exclusive use by the Army Nutrition Laboratory of four beds in the Hospitals at a specified daily rate. The University's claim was for $6,868.40. The Comptroller General of the United States approved payment of only $361.90 on the ground that the beds assigned to the Army Nutrition Laboratory were not always occupied, notwithstanding that they were reserved for its exclusive use. The Board of Trustees approved the institution of these legal proceedings, including the employment of the law firm of Fisher, Wayland, Duvall, and Southmayd of Washington, D.C., as special counsel for the University. On November 20, 1953, the Board authorized the Comptroller and the Legal Counsel to make a compromise settlement of the claim contemplating the award of judgment for the University in the sum of $5,000 thereon since it appeared that such a compromise was feasible and that protracted litigation would be costly. The University's attorneys have reported to the Legal Counsel that on January 5, 1954, judgment was entered in favor of the University in the agreed sum of $5,000 by the United States Court of Claims. It will, however, be some time before the University receives payment since an appropriation by Congress will be necessary. W h e n payment is made to the University, I recommend that the Acting Comptroller be authorized to accept same and to pay the legal fees and other expenses in accordance with the terms agreed to by the University.

On motion of Mrs. Watkins, this report was received for record and authority was given the Acting Comptroller as recommended.
