Mr. Fair recommended that the University approve the project and offer to purchase land from the Medical Center Commission, as a site, for $50,000; and that the Foundation be requested to apply to the Equitable Life Assurance Society for a loan. After discussion, and on motion of Mr. Livingston, the Board took action, by unanimous vote of record, as follows: I. The proposed project was approved, on condition that it can be set up on substantially the basis presented. II. The offer to purchase land for $50,000 from the Medical Center Commission was authorized, and funds were appropriated to cover the purchase. III. The University of Illinois Foundation was requested to apply for a loan to cover the total cost of construction, excluding land, the details to be approved by the University, including an agreement to lease the properties from the Foundation for an annual rental equal to the debt service. IV. The Committee on Chicago Departments was authorized to negotiate and recommend to the Board arrangements with architects for the preparation of plans and other matters necessary for the completion of the project.

WAIVER OF PATENT POLICY IN RESEARCH CONTRACTS WITH UNITED STATES GOVERNMENT (9) The Executive Committee of the Board of Trustees has informally approved the inclusion of the following patent clause in contracts with the United States Government involving funds supplied by the Atomic Energy Commission. Such provision is contrary to the University policy on patents, but is necessary due to Federal Statute governing the Atomic Energy Commission; and, if the University is to continue research work with funds provided by such Commission, such patent provision must be accepted. " ( 1 ) With respect to each Subject Invention within the scope of this paragraph made by employees of Contractor, except clerical and manual labor personnel who will not have access to technical data, the Contractor shall furnish the United States Atomic Energy Commission (hereinafter in this paragraph called 'the Commission') with complete information thereon. The Commission shall have the sole power to determine whether or not and where a patent application shall be filed and to determine the disposition of the title to and rights under any application or patent that may result. T h e judgment of the Commission on these matters shall be accepted as final; and the Contractor agrees to obtain the execution of and deliver to the Commission all documents relating to each such Subject Invention and do all things necessary or proper to carry out the judgment of the Commission. " ( 2 ) No claim for pecuniary award or compensation under the provisions of the Atomic Energy Act of 1046 shall be asserted by the Contractor or its employees with respect to any such Subject Invention. " ( 3 ) Except as otherwise authorized in writing by the Commission the Contractor will obtain patent agreements to effectuate the purposes of subparagraphs ( i ) and (2) of this paragraph from all persons who perform any part of the work under this contract, except clerical and manual labor personnel who will not have access to technical data. " ( 4 ) Except as otherwise authorized in writing by the Commission the Contractor will insert this paragraph in all subcontracts." Confirmation of the action of the Executive Committee in authorizing the inclusion of such section in government contracts is requested.

On motion of Mr. Livingston, the inclusion of these sections in government contracts was approved and confirmed.
