filing of such acceptance) granting permission and authority "to the University of Illinois, a corporation, its successors and assigns, upon the terms and subject to the conditions of this ordinance, to excavate for, install and maintain conduits, tunnels, steam and condensate pipes and related accessories in any and all streets, avenues, alleys, and public places within the boundaries of the 'Medical Center District' as now or hereafter established," in said City of Chicago; such acceptance to be in the form submitted to this meeting; that the Secretary of this Board be and he is hereby directed to file with the records of this meeting, properly identified, a copy of such acceptance in the form submitted to this meeting; and that the Comptroller and the Secretary of this Board be and they are hereby authorized, empowered and directed, at the time of filing such acceptance with such City Clerk, to pay to the City of Chicago, in the name and on behalf of this Board, as compensation for the privileges granted in and by such ordinance, the sum of Ten Dollars ($10.00), for the full term of such ordinance, in compliance with the provisions of Section 4 of such ordinance. Ordinance Be it Ordained by the City Council of the City of Chicago: SECTION I . Permission and authority hereby are given and granted to the University of Illinois, a corporation, its successors and assigns, upon the terms and subject to the conditions of this ordinance, to excavate for, install and maintain conduits, tunnels, steam and condensate pipes and related accessories in any and all streets, avenues, alleys, and public places within the boundaries of the "Medical Center District" as now or hereafter established, the present boundaries being Ashland Boulevard on the East, a line co-incidental with Congress Street extending from Ashland Boulevard in a westerly direction to Oakley Boulevard on the North, Oakley Boulevard on the West and Roosevelt Road on the South, together with the necessary manholes, for a period of forty (40) years from and after the date of the passage of this ordinance, and thereafter until terminated by at least six months' written notice by the City to the grantee, or by like notice from the grantee to the City. SECTION 2. Said conduits, tunnels, steam and condensate pipes, accessories and manholes shall be installed under the supervision and to the satisfaction of the Commissioner of Public Works and shall be maintained in accordance with the ordinances of the City of Chicago and the directions of the Commissioner of Public Works. If and when requested by the Commissioner of Public Works, the grantee shall file with such Commissioner at any time or from time to time, as and when any construction work is done by the grantee pursuant to this ordinance, a plat or plats showing the location of said conduits, tunnels, steam and condensate pipes, accessories and manholes. The grantee shall keep that portion of any street, avenue, alley or public way over the structures and appliances herein authorized, and the openings thereto, in good condition and repair, safe for public travel, to the satisfaction of the Commissioner of Public Works. Upon termination of the privileges herein granted by lapse of time, or otherwise, the grantee, without cost or expense to the City of Chicago, shall, upon the written request of the City, remove the structures and appliances herein authorized, and in the event of the failure, neglect or refusal of the grantee so to do, the City of Chicago may do said work and charge the cost thereof to the grantee. SECTION 3. The grantee will hold and save the City of Chicago harmless from any and all liability for cost of removal, relocation, alteration, repair or maintenance of the structures or appliances herein authorized and from any and all damages thereto on account of the location, construction, reconstruction, alteration, repair or maintenance of any public ways, bridges, subways, tunnels, vaults, sewers, water mains, conduits, pipes, poles and other utilities. SECTION 4. The grantee agrees to pay the City of Chicago as compensation for the privileges herein granted the sum of Ten Dollars ($10.00) for the full term of this ordinance, said payment to be made as of the date of the acceptance of this ordinance. SECTION 5. This ordinance shall take effect and be in force from and after its passage, provided the grantee files a written acceptance of this ordinance with the City Clerk within six months after the passage of this ordinance.
