Company is unable to correct such deficiency for reasons as set forth in Section 10 hereof. The adequacy of the water supply furnished to the University shall be determined at the point of delivery at the service valve and Master Meter above mentioned, as determined from time to time by the National Board of Fire Underwriters, and in any case a water supply at the rate of one thousand (1,000) gallons per minute, United States Standard Liquid Measure (or such other amount as the parties hereto shall agree upon), shall be deemed to be adequate for all purposes of this agreement unless the National Board of Fire Underwriters shall determine otherwise. The Water Company agrees to conduct such studies as may be necessary for the long term future water supply of the University and the community and to furnish to the University such physical plant data as may be necessary to assure the University of the adequacy of the water supply, but the Water Company shall not be required to furnish such data more than once in each calendar year. 5. The University agrees to comply with all of the rules and regulations of the Water Company from time to time on file with the Illinois Commerce Commission and governing service in the Cities of Champaign and Urbana; provided, however, that if at the date of this agreement it is necessary for the University to do any work or install any facilities in order to comply with such rules and regulations, the University shall have a period of five (5) years from and after the date of this agreement to install such facilities or to do such work, except in cases where non-compliance with such rules and regulations may in any way affect the bacteriological quality of the water furnished by the Water Company, in which case it shall be the duty of the University to comply immediately with such rules and regulations. 6. It is understood that water furnished under this agreement may be used by the University for cooling purposes or for other processing purposes, comparable with any existing industrial use permitted by the Water Company without imposing any restrictions. If there shall hereafter be any change in the rules and regulations respecting the use of water for any of the purposes specified in this paragraph, the University shall be entitled to the benefit of any such change to the same extent as other customers of the Water Company. In case of any dispute with respect to the foregoing, both parties agree to jointly submit the question to the Illinois Commerce Commission and to abide by any ruling, whether formal or informal, given by the said Commission. 7. Nothing in this agreement contained shall be deemed to prohibit the University from producing such quantities of raw water as may be needed for research in the field of biology or any other research where the treated water served by the Water Company is not suitable. The University agrees that it will under no circumstances permit any cross connection of any kind to be made between any such raw water supply and the treated water supply furnished by the Water Company. 8. The University agrees that so long as this agreement shall remain in force, it will maintain its existing water wells throughout their expected life but, from and after the time when the Water Company shall commence to furnish the entire water supply of the University such wells will be maintained for standby and emergency purposes only; provided, always, that such wells may be operated periodically for test purposes as may be deemed necessary or advisable by administrative authorities of the University responsible for the water supply, but the water produced from such test runs shall not be utilized by the University unless it meets the standards approved by the United States Public Health Service. Such test runs may be made at approximately thirty (30) day intervals during the life of this agreement and may be of approximately two (2) hours duration. 9- The unit of measurement for the water delivered hereunder shall be one thousand (1,000) gallons of water, United States Standard Liquid Measure. For the purposes of measurement of water delivered hereunder, it is understood that 7.48 gallons of water shall constitute one (1) cubic foot. It is further understood that the meter to be originally installed at the service valve hereinbefore referred to shall be a Venturi meter. T h e University shall have access to the said Master Meter, but the reading and calibrating and adjustment of such Master Meter shall be done only by the employees or agents of the W a t e r Company. For the purposes of this agreement the original record of reading of any meter (including the Master Meter) shall be the journal or other record book of the Water Company in its office in which the records of the employees or agents of the W a t e r
