and the Cities of Champaign and of Urbana, filed with the Civil Aeronautics Board on June 27, 1946. The Legal Counsel was directed to prepare the necessary exhibits and briefs and continue with the case.

CONDEMNATION OF SITE FOR CHEMISTRY BUILDING

The 1 -egal Counsel presented also the following Resolution and recommended its adoption:

Be it resolved by T h e Board of Trustees of the University of Illinois thai the following described real estate, located in the City of Urbana, County of Champaign, and State of Illinois, viz: TRACT 1 : — Lot Six (6) of Block Two (2) of Nina B. Bronson's Subdivision of a part of the East Half of the Southwest Quarter of the Northeast Quarter of Section Eighteen (18), Township Nineteen (19) North, Range Nine (9) East of the Third Principal Meridian in Champaign County, Illinois, and TRACT 2: — L o t s One (1) and T w o (2) and the East Thirteen (13) feet of Lot Three (3) in Block Two (2) of Nina B. Bronson's Subdivision of a part of the East Half of the Southwest Quarter of the Northeast Quarter of Section Eighteen (18), in Township Nineteen (19) North, Range Nine (y) East of the Third Principal Meridian in Champaign County, Illinois, and each and both of tracts One and Two above described, is and are needed by the University of Illinois for educational purposes of the University and to enable it to discharge its duties to the public, and for public use; that funds available for the purchase of this real estate have been appropriated by the General Assembly of the State of Illinois; the Board of Trustees has, directly and through its duly authorized agent, Sidney B. Trelease, negotiated with Robert E. Milligan, the owner of both tracts of real estate, for the purchase of this real estate and each of the tracts above described; and offers by the Board oi Trustees, directly and through its duly authorized agent, Sidney B. Trelease, have been made to Robert E. Milligan to purchase these tracts of real estate, and each and both of them, and Robert E. Milligan has refused to accept the offers so made for the purchase thereof; and Robert E. Milligan has, in said negotiations, offered to sell and convey this real estate to the Board of Trustees of the University of Illinois for a consideration and price which the Board of Trustees has refused to pay therefor. Be it further resolved, that it is hereby declared that compensation to be paid for the purchase of said property can not be agreed upon between this Board of Trustees and Robert E. Milligan, and that Robert E. Milligan and this Board of Trustees are unable to agree upon the purchase price to be paid Robert E. Milligan for the property. It is further resolved by the Board of Trustees, that the necessary and appropriate action be taken for the acquisition of this property by proceedings in eminent domain, and that the Legal Counsel of the University and of the Board of Trustees, is hereby authorized to proceed accordingly and to employ legal counsel to assist in the prosecution of eminent domain proceedings.

Mr. Britton stated that the Resolution seeks to consolidate the various actions of the Board of Trustees with respect to the condemnation of the Milligan property. Authority is granted in the Resolution for the appointment of outside counsel. On motion of Mr. Williamson, this resolution was adopted by the following vote: Aye, Mr. Davis, Mr. Fornof, Mrs. Grigsby, Mr. Livingston, Dr. Luken, Mr. McKelvey, Mr. McLaughlin, Dr. Meyer, Mr. Nickell, Mr. Williamson; no, none; absent, Mr. Green.
