APPROPRIATION FOR COMMITTEE ON PATENTS (9) T h e operating budget for 1945-1946 includes an item of $1,500 for the Faculty Committee on Patents. This is insufficient, and I recommend that a supplementary appropriation of $2,000 be made from the General Reserve Fund to the Committee on Patents for patent expenses.

On motion of Mr. Davis, this appropriation was made as recommended, by the following vote: Aye, Mr. Davis, Mr. Fornof, Mrs. Grigsby, Mr. Livingston, Mr. McKelvey, Mr. McLaughlin, Mr. Williamson; no, none; absent, Mr. Green, Dr. Luken, Dr. Meyer, Mr. Nickell.

REPORT OF COMMITTEE ON PATENTS

At this point, Mr. Davis, for the Committee on Patents, reported the following recommendations.

1. That two discoveries resulting from research of a highly confidential nature be released to the federal government. 2. That the recommendation that contracts for research investigations by private industries and other agencies be amended by the insertion of a provision for royalty-free exclusive licenses to the sponsor be not approved. 3. That the following procedures be adopted for dealing. with patentable discoveries made by members of the University staff, as they are reported: ( a ) T h e Faculty Committee on Patents may consult with the University's patent attorneys immediately, without prior authorization by the Board of Trustees. (b) If, in the judgment of counsel, the discovery should be patented, an application for patent shall be filed immediately and reported to the Board at the next opportunity. (c) If in the judgment of the Faculty Committee, the University would not be justified in expending funds for a patent application, a recommendation shall be made to the Board for the release of the discovery to the discoverer. 4. T h a t the following revision (recommended by the Comptroller) of the principles governing charges for indirect costs incurred in conducting research financed and sponsored by outside agencies be adopted.

POLICY RELATING TO RESEARCH CONTRACTS

(As adopted by the Board of Trustees on January 24, 1942, and amended on October 18, 1945) I Sponsors of special or specific researches to be carried on under the direction and supervision of the University, in general, shall be grouped as follows for the purpose of determining rights in patentable discoveries. (1) Individuals, natural persons, and corporations interested in patentable discoveries which may grow out of the sponsored research; (2) Associations of individuals, manufacturers, utilities, and similar groups, interested in any patentable discoveries which may result from the prosecution of the sponsored research; (3) Public governmental agencies, including the United States Government and its agencies, and any of the states of the Union and their agencies, not interested in or concerned about patentable discoveries; (4) Technical societies, committees, foundations, and the like which sponsor special or specific researches, but are not interested in or concerned about patentable discoveries which may grow out of the research. II Sponsors falling within groups (1) and (2) will be expected to enter into contracts containing, among other things, the following clauses and paragraphs:
