—Offer Date of Offer: December 19, 1963 University of Ulinois-Willard Airport Project No. 9-11-026-C404 Contract No. FA-CE-2919 To: T h e Board of Trustees of the University of Illinois, and State of Illinois, Department of Aeronautics, Co-Sponsors, (herein referred to as the "Sponsor") F R O M : The United States of America (acting through the Federal Aviation Agency, herein referred to as the " F A A " ) WHEREAS, T h e Board of Trustees of the University of Illinois has submitted to the F A A a Project Application dated January 26, 1961, and the State of Illinois, Department of Aeronautics, and The Board of Trustees of the University of Illinois have submitted to the F A A a Project Application dated September 27, 1963, for projects for development of the University of Ulinois-Willard Airport (herein called the "Airport"), which Project Applications as approved by the FAA are hereby incorporated herein and made a part hereof; and WHEREAS, the F A A has approved a project for development of the Airport (herein called the "Project") consisting of the following-described airport development: Reimburse for N and S clear zone acquisition; acquire N W and S E clear zones and A L S site in S E approach to N W / S E ( I L S ) runway; install highintensity lighting system for N W / S E runway; install instrument-runway marking on N W / S E runway; install perimeter fencing on A L S site; remove obstructions, all as more particularly described in the property map and plans and specifications incorporated in the said Project Applications; Now therefore, pursuant to and for the purpose of carrying out the provisions of the Federal Airport Act, as amended (49 U.S.C. 1101), and in consideration of (a) the Sponsor's adoption and ratification of the representations and assurances contained in said Project Application, and its acceptance of this Offer as hereinafter provided, and (b) the benefits to accrue to the United States and the public from the accomplishment of the Project and the operation and maintenance of the Airport as herein provided, T H E F E D E R A L A V I A T I O N AGENCY, FOR AND ON BEHALF OF T H E UNITED STATES, HEREBY OFFERS A N D A G R E E S to pay, as the United States share of the allowable costs incurred in accomplishing the Project, 50 per centum thereof, P R O V I D E D , H O W E V E R , that the United States' share of the allowable costs incurred in accomplishing the installation hereunder of the high-intensity lighting system on the N W / S E designated instrument landing runway and the acquisition of the 3200' x 400' site for an Approach Light System in the S E approach thereto shall be 75 per centum thereof. This Offer is made on and subject to the following terms and conditions: 1. The maximum obligation of the United States payable under this Offer shall be $92,443.00. 2. T h e Sponsor shall: ( a ) begin accomplishment of the Project within ninety days after acceptance of this Offer or such longer time as may be prescribed by the F A A , with failure to do so constituting just cause for termination of the obligations of the United States hereunder by the F A A ; ( b ) carry out and complete the Project without undue delay and in accordance with the terms hereof, the Federal Airport Act, and Sections 550.7 and 550.8 of the Regulations of the Federal Aviation Agency (14 C F R 550) in effect as of the date of acceptance of this Offer; which Regulations are hereinafter referred to as the "Regulations"; ( c ) carry out and complete the Project in accordance with the plans and specifications and property map, incorporated herein, as they may be revised or modified with the approval of the F A A . 3.
