Illinois, that the Comptroller and the Secretary of this Board of Trustees be, and they hereby are, authorized to execute, acknowledge, and deliver in the name and on behalf of this Corporation such instruments of conveyance, contract, or other document or documents as to them may seem necessary or desirable in order to grant to ILLINOIS POWER COMPANY, an Illinois corporation, hereinafter referred JO a s "Grantee," its successors and assigns, tbe right and easement to reconstruct, operate, repair, and maintain its poles, wires, and fixtures, for the purpose of an electric transmission or distribution line o r system, upon and over the land hereinafter described and the right of ingress to and egress therefrom. Grantee shall agree to repair any damage to property of this Corporation and to pay for any damages which may be caused to properties of this Corporation by the reconstruction, operation, repair, or maintenance of said electric transmission or distribution line or system. The right-of-way easement shall terminate when Grantee ceases to use said electric transmission or distribution line or system for rendition of service. The right-of-way easement shall be over the following-described property: The South 20 feet of all that part of the South Half of the Southeast Quarter of Section 24, Township 19 North, Range 8 East of the Third Principal Meridian, in Champaign County, Illinois, which lies East of the East line of the present Illinois Central Railroad right-of-way, excepting, however, from said parcel of land the East 353 feet thereof. Resolution WHEREAS, T h e Board of Trustees of the University of Illinois, a public corporation, is the present owner of the following-described tract of land, hereinafter referred to as "Tract A," in the County of Champaign in the State of Illinois, to-wit: All that part of the South half ( S W) of the Southeast Quarter ( S E VA) of Section Twenty-four (24), Township Nineteen (19) North, Range Eight ( 8 ) East of the Third Principal Meridian, in Champaign County, Illinois, which lies East of the East line of the present Illinois Central Railroad right-of-way excepting, however, from said parcel of land the East three hundred sixtythree (363) feet thereof; which said Tract A is subject among other land to a certain Agreement for Right-of-Way dated Julv 6, 1931, made by C. A. Percival and Etta Luella Percival, husband and wife, in favor of Panhandle Illinois Pipe Line Company, an Illinois corporation, its successors and assigns; and WHEBEAS, Panhandle Eastern Pipe Liue Company, a corporation, hereinafter referred to as "Panhandle," has succeeded to all of the right, title, and interest < Panhandle Illinois Pipe Line Company in, to, and under the above-described j f Agreement for Right-of-Way; and WHEREAS, under and pursuant to the above-described Agreement for Rightof-Way, there has heretofore been constructed on aud across the above-de scribed Tract A a high-pressure natural gas transmission pipeline owned, operated, and maintained by Panhandle; and WHEREAS, this Board of Trustees desires that Panhandle release, surrender, ?«d relinquish all of Panhandle's rights under said Agreement for Right-of-Way "i so far and in so far only as said Agreement for Right-of-Way covers, affects <* pertains to the above-described Tract A, save and except, however, for a fertam strip of land hereinafter described.
