owners have agreed to accept $65,000, and to give possession no later than July 31, 1961, payment in full to be made at that time. Conveyance of the property would be subject to the rights of tenants whose leases will expire not later than September 1, 1961. The sellers would pay the real estate taxes for the year 1960, due in 1961; and taxes for the year 1961 payable in 1962 would be pro-rated between them and the University as of the date of possession on the basis of the calendar year and the 1960 taxes. Funds are available in the Housing Division surplus and reserves for the purchase of the property. I recommend: (a) approval of this property purchase at the price indicated; (b) that the Comptroller and the Secretary of the Board be authorized to execute a contract for the same, subject to its approval by the Legal Counsel; and (c) that funds be assigned from Housing Division surplus and reserves for the acquisition of this property, provided that funds so advanced will be repaid from the income of the property if used for housing, and provided further that in the event the house is converted to general University use at some future time, other University funds be transferred to the Housing Division for the liquidation of (he balance of the funds advanced. On motion of M r . Pogue, the purchase of this property at a price of $65,000 was authorized in accordance with the terms indicated, and the other foregoing recommendations were approved; this action w a s taken by the following vote: Aye, M r . SPECIAL C O U N S E L FOR GARFIELD PARK LITIGATION

(2) Mr. Albert E. Jenner, Jr., of the law firm of Thompson, Raymond, Mayer, Jenner, and Bloomstein, Chicago, has been serving as special counsel in the appeal to the Supreme Court of Illinois of the decision of the Circuit Court of Cook County In the Garfield Park case. The Legal Counsel requested instructions concerning further employment of Mr. Jenner and his firm in the event the Appellees seek a rehearing by the Supreme Court of Illinois or appeal is taken to the Supreme Court of the United States. On motion of M r . Swain, the Board authorized the continued employment of M r . Jenner and his firm to such an extent as in the j u d g ment of the President of the University and of the Legal Counsel is deemed advisable. SECRETARY'S REPORTS The Secretary presented for record the following lists: ( 1 ) appointments made by the President; ( 2 ) graduate fellows; ( 3 ) declination and resignations; ( 4 ) leave of absence; ( 5 ) cancellation of sabbatical leave of absence; ( 6 ) retirement.
