tinental Builders, Inc. would have been permitted to proceed with the performance of the contract. The suit, unless settled, will be placed on the trial calendar, and will have to be tried in January. As a result of negotiations which have been conducted, and pre-trial hearings which have been held, during the past three weeks, the University has received an offer from Continental Builders, Inc. to accept $6,500 in full settlement and satisfaction of all of the claims sued upon in the suit and asserted by it against the University. In view of the moral obligation arising out of the fact that, unknown to the University, the surety on the last performance bond tendered by Continental Builders, Inc. possessed the required ratings at that time, and the expense and inconvenience of trying the suit, special counsel for the University (Mr. George Jirgal of Chapman and Cutler and Ralph F. Lesemann), the Legal Counsel, the Director of the Physical Plant, and the Vice-President and Comptroller recommend that this offer of settlement be accepted, and that said sum be paid Continental Builders, Inc. in return for a full and complete release against the University, approved by special counsel handling this matter for the University, and the dismissal, with prejudice to Continental Builders, Inc. and at the latter's costs, of the pending suit.
