BOARD OF TRUSTEES

T h e University Counsel has filed an answer to the petition on behalf of all respondents.

The Secretary Pro Tempore also read a letter from the University Counsel, dated August 26, 1942, reporting on developments in this case to date. A copy of the letter was filed with the Secretary of the Board for record. Mr. Cleary offered the following resolution and moved its adoption:

Whereas, the Attorney General of Illinois has filed a motion to strike the answer of the University heretofore filed by it through the University Counsel pursuant to authority heretofore granted and hereby ratified in the case of People, ex rel Petrone and Zazove vs University of Illinois, et al; Circuit Court of Cook County, Illinois, General No. 42-C-11035; Now, therefore, be it resolved, that the University Counsel be and he is hereby authorized to take any and all action in the Courts of this State, which in his judgment may be necessary to protect the rights and interests of the University in the premises.

This resolution was adopted.

SALARIES OF NORVAL D. HODGES AND SVEINBJORN JOHNSON M r . C l e a r y offered t h e f o l l o w i n g r e s o l u t i o n a n d m o v e d its a d o p t i o n : Whereas, the Auditor of Public Accounts of the State of Illinois by the direction of the Attorney General has refused and refuses to issue and deliver his warrants on the State Treasurer for the salaries of Norval D. Hodges and Sveinbjorn Johnson, in violation of their contracts with the Board of Trustees; Now, therefore, be it resolved, that the University Counsel be and he is hereby authorized to take any and all action in the courts of this State which in his judgment may be necessary to protect the rights arid interests of the University in the premises. This resolution was adopted. T h e B o a r d r e s u m e d c o n s i d e r a t i o n of m a t t e r s p r e s e n t e d b y P r e s i dent Willard. PURCHASE OF PROPERTY AT 1 2 1 0 WEST ILLINOIS STREET (23) The Director of the Physical Plant Department reports that the property at 1210 West Illinois Street, Urbana, has been offered for sale to the University. T h e property consists of a lot 43' x iigYz' and a residence, which is used as a student rooming house. It is in the block directly east of the Natural History Building in an area where there is considerable unimproved property and which area the University may well acquire for future expansion. T h e Director of the Physical Plant Department recommends purchase of the property at a price of $8,500. This will require a special appropriation. I recommend authorization of this purchase and an appropriation of $8,500 for this purpose. O n m o t i o n of M r . D a v i s , t h e p u r c h a s e of t h i s p r o p e r t y w a s a u t h o r ized, a n d a n a p p r o p r i a t i o n of $ 8 , 5 0 0 w a s m a d e f r o m t h e G e n e r a l R e s e r v e F u n d for this purpose by the following vote: Aye, M r . A d a m s , Mr. Cleary, M r . Davis, M r . Fornof, M r s . Grigsby, M r . Jensen, Dr. M e y e r ; no, n o n e ; absent, Mr. Green, Mr. K a r r a k e r , M r . Livingston, Mr. Wieland. PURCHASES RECOMMENDED (SUPPLEMENTARY) (24) A recommendation that the following purchases be authorized: 1. Reducing and desuperheating equipment for the Abbott Power Plant from the Republic Flow Meters Company, Chicago, at a price of $3,136.50. 2. 37 Special Pelton Crane dental operating lights for the Dental Clinics from the Pelton Crane Company, Detroit, Michigan, at a price of $2,109 f.o.b.
