CANADIAN PATENT ON FELLOWS COAL BURNER DEVICE (23) Associate Professor J. R. Fellows has developed a device for use in the construction of furnaces and other heaters for the smokeless combustion of coal, which has been patented and the rights thereto assigned to the University. The Board has assigned these rights to the University of Illinois Foundation for the commercial development of the discovery. Application for a patent covering an important improvement in this device has also been made, but the United States Patent Office has not acted on this application. T h e Faculty Committee on Patents recommends that Professor Fellows be authorized to apply for a patent in Canada covering the improvement in his device, with the understanding that the University will pay the expenses thereof and that the rights to the patent will be assigned to the University in the usual way. If the Board of Trustees does not approve financing such an application the Committee recommends that permission be given Professor Fellows to make application at his own expense and on his own behalf. T h e Committee further recommends that if application for Canadian patent protection is authorized the filing of such an application be deferred until the United States Patent Office has acted on the application now pending, for the reason that if the United States Patent Office rejects the application for the improvement it is quite likely that the University would not be interested in filing an application for a Canadian patent. I concur in this recommendation. O n m o t i o n of M r . TERMINATION OF FINE ARTS GALLERY ASSOCIATION (24) On May 28, 1040 (Minutes, page 946), the Board was advised of an offer made by Mr. Percy H. Sloan of the Class of 1886 to raise funds for a Fine Arts Museum or Gallery for the University of Illinois. Mr. Sloan himself offered $25,000 for this Museum and $5,000 for the upkeep of paintings which he proposed to present to the University. On September 27, 1940 (Minutes, page 54), the Board authorized the organization of a Fine Arts Gallery Association, which was incorporated on January 30, 1941, for the purpose of raising funds for said project and to perform such corporate functions as were necessary in carrying out its objectives. Such funds as were received for this project were to be deposited in escrow with the Northern Trust Company Bank of Chicago. Mr. Sloan was a party to the escrow agreement which provided that if by January 1, 1943, there were not sufficient funds on hand for the construction of the Fine Arts Gallery Building the funds shall be returned to the several donors on demand. Later the time limit was extended to January 1, 1944. Mr. Sloan had deposited $25,000 in accordance with his original offer. Recently Mr. Sloan has indicated his desire to terminate this arrangement, since there is no likelihood that there will be sufficient funds by January I, 1944, to cover the cost of constructing a Fine Arts Gallery Building. Under the circumstances, the Fine Arts Gallery Association has terminated its agreement with the Northern Trust Company of Chicago and the escrowship of the funds held for it and has returned the contributions to the various donors, including the restoration of funds to Mr. Sloan which he had advanced.
