ness; and to examine and verify all records, in connection with the services and instructions to be performed under this agreement. ARTICLE VII. The United States reserves the right to determine the adaptability of students for instruction in ground training, and at any time may withdraw such students as in the judgment of authorized representatives of the Director of Military Aeronautics do not appear to possess the necessary aptitude. ARTICLE VIII. The contractor assumes responsibility for all damage, loss or destruction of equipment by students during the course of instruction and tests. ARTICLE IX. The contractor further agrees to hold and save the United States harmless from and against all and every demand, or demands, of any nature or kind for, or on account of, the use of any patented invention, article, or process included in work to be done under this contract. ARTICLE X. Neither this contract nor any interest herein shall be transferred to any other party or parties, and in case of such transfer, the United States may refuse to carry out this contract either with the transferrer or the transferee, but all rights of action for any breach of this contract by said contractor are reserved to the United States. ARTICLE XI. No member of, or delegate of Congress, nor any person belonging to, or employed in, the military service of the United States, is or shall be admitted to any share or part of this contract, or to any benefit which may arise therefrom. However, if this contract is made with an incorporated Company, this stipulation, so far as it relates to members or delegates of Congress, is not to be construed to extend to this contract. ARTICLE XII. This contract shall be subject to approval of the Director of Military Aeronautics.
