B. Letter from William B. McKinley agreeing to conditions mentioned in the letter of November 10, but objecting to two provisions in the proposed agreement. f Alterations were made in accordance with these suggestions and the final form agreed upon as printed above. C. Copy of letter from Hon. William B. McKinley, president of the Illinois Traction System, stating that he had signed in two copies the agreement printed above. D. A letter from the supervising architect of the University, James M. White, stating that the proposed agreement printed above seems to him to conserve adequately the interests of the University. E. A letter from Dr. O. A. Harker, counsel for the University, to the effect that the proposed agreement, printed above, does not endanger, in his opinion, any right or interest which the University has in the premises covered by or adjacent to the proposed line of railway. F. A letter from Dr. T. J. Burrill, vice president of the University, in charge of the campus, dated December 5, giving as his opinion that the proposed form of indenture safeguards the interests of the University with the possible exception that nothing is said concerning what kind of cars or what traffic is permitted on the track.

MY DEAR MB. MCKINLEY—Hon. W. L. Abbott, president of the Board of

Trustees of the University of Illinois, has forwarded to me certain papers relating to the application of the Urbana and Champaign Railway, Gas and Electric Company for a permit to cross the grounds of the University of Illinois. He found that the draft of the agreement which he had prepared and which you signed was not entirely satisfactory to some of his associates. He has asked me to put the matter into shape as soon as possible for final action by the Board of Trustees, and it is on this account that I am writing you at the present time. r, I desire very much that the matter shall be closed up as soon as possible so that the track may be put in before cold weather and that the agreement may be framed in such a way as to command the unanimous approval of the Board of Trustees. I hope that this can now be done. I am inclosing a draft of an agreement, therefore, prepared by the counsel for the University and containing an exact description in words of the route agreed upon between Mr. Abbott and Mr. Mattis, and approved by the Board of Trustees and outlined on the blue-print submitted by your" engineer, which, if satisfactory to the street car company, you may sign and return at your early convenience for submission to the Board of Trustees at its next meeting. There is a strong feeling on the part of many members of the board that surface railway lines should not cross the campus at more than two points, and that if permission is given to the street car company to cross the campus from California av. to Daniel street and the old right of way be continued in use, the line on Green street should be removed. The Board of Trustees, at a meeting held July 20, 1907, authorized Mr. Abbott and myself to complete an agreement with the company in all details along the lines laid down in the report of the committee, which was approved in general by the board, and which was based upon the understanding with Mr. George A. Mattis, assistant treasurer and representative of the street railway company. One condition of the making of this agreement, however, reads as follows: "The granting of this right of way to be contingent -on the part of the University upon the agreement with the railway company to remove their tracks from Green street as soon as the crossing on the south campus is completed.',
