I n cases w h e r e t h e p a r t i c u l a r p o w e r u n d e r discussion h a s been before t h e S u p r e m e Court of Illinois t h e rule, h a s been uniformly s t a t e d s u b s t a n t i a l l y as follows: I n t h e exercise of t h e p o w e r of e m i n e n t domain, w h i c h t a k e s t h e p r o p e r t y of t h e citizen a w a y from h i m w i t h o u t his consent, t h e l i m i t a t i o n s prescribed b y t h e Constitution should be s t r i c t l y observed, a n d t h e s t a t u t e s passed in p u r s u a n c e thereof should be s t r i c t l y complied w i t h a n d n o t e x t e n d e d by implication. I am. t h e r e f o r e of t h e opinion t h a t t h e University cannot, u n d e r t h e l a w as i t n o w exists, condemn p r i v a t e p r o p e r t y for t h e use of t h e University. A l t h o u g h I w a s only asked for my opinion on t h e l e g a l question involved, I do n o t t h i n k it o u t of t h e w a y for me to s u g g e s t t h a t some legislation should be procured t h a t w i l l enable t h e University a n d o t h e r e d u c a t i o n a l i n s t i t u t i o n s belonging to t h e S t a t e to condemn. If t h e p r e s i d e n t a n d m e m b e r s of t h e .board desire me to do so I will open corresponence a t once w i t h t h e A t t o r n e y General a n d t h e h e a d s of t h e different n o r m a l schools, w h i c h s h a l l h a v e in view t h e securing of such legislation. AUTHORITY TO ISSUE PERMITS TO CROSS UNIVERSITY GROUNDS.

I t was voted that the trustees request the present Legislature to pass a law giving to them authority to issue permits to cross the University grounds to street railways, telephone, and telegraph companies, and that Judge O. A. Harker be requested to draw said bill. The secretary was directed to send a vote of thanks to the members of the Urbana Commercial Club for their courtesy in entertaining the board of trustees by a banquet Tuesday evening.

KEPORT ON ATHLETICS.

The special committee appointed to examine into the condition of •athletics made the following report, which was received for record.

To the Board of Trustees. Your committee m a d e its e x a m i n a t i o n s to d e t e r m i n e t h e facts w h i c h exist in t h e University pertaining" t o a t h l e t i c s a l o n g t h e following lines: (1) By w h o m is a t h l e t i c s controlled? (2) Can t h e d a n g e r of injury be removed from t h e r o u g h games? (3) H o w far is money or favor used to r e c r u i t m e n for a t h l e t i c s ? I n order to o b t a i n t h e i n f o r m a t i o n w h i c h t h e c o m m i t t e e desired t h e princip a l m e n w h o h a v e t o do w i t h t h e c o n t r o l a n d direction of a t h l e t i c s h e r e w e r e invited to come before t h e committee. T h e a n s w e r s given by t h e s e m e n w e r e t a k e n s t e n o g r a p h i c a l l y for t h e use of t h e committee a n d copies of c o n s t i t u t i o n and by-laws of t h e A t h l e t i c Association w e r e s u b m i t t e d . T h e persons examined w e r e : Professor H. J. B a r t o n , a m e m b e r of t h e Board of Control. Mr. George A. Huff, director of Athletics. Professor G. A. Goodenough, c h a i r m a n of t h e Council Committee of A t h letics. Mr. W. J. Carey, p r e s i d e n t of t h e A t h l e t i c Association. Mr. W. J.
