TRANSFER OF TITLE TO VETERANS HOUSING UNITS TO UNIVERSITY (33) The title to veterans housing units located in Champaign-Urbana is now in the Federal government. They are operated by the University under an operating agreement whereby the University submits reports of operations and remits net operating revenues. The transfer of complete ownership and control of these units to the University was authorized by Congress under Public Law 796, signed by President Truman on June 28, 1948, such transfer to be effective on the first day of the month following the month in which the University's application is approved. A request for such a transfer must be submitted prior to October 26, 1948. This authority to transfer extends to only those units located on ground owned by the University and would not apply to those units located at Galesburg. It is highly desirable that the University take advantage of this authority since it would make it possible to operate these units according to general University housing policies and eliminate any conflict with the policies of the Federal Public Housing Authority. Such transfer would also relieve the University of the additional administrative expense necessary in maintaining records according to the requirements of the Federal government and submitting reports of operations to it. The Director of the Physical Plant Department and the Comptroller recommend the adoption of the following resolution. I concur and request that the Comptroller and Secretary of the Board be authorized to sign all documents necessary to effect this transfer.

On motion of Mrs. Holt, the following resolution was adopted, and authority was given as recommended, by the following vote: Aye, Mr. Fornof, Mrs. Holt, Mr. Livingston, Mr. McKelvey, Mr. McLaughlin, Mr. Nickell; no, none; absent, Mr. Davis, Mr. Green, Dr. Luken, Dr. Meyer, Mr. Williamson.

RESOLUTION

Whereas an act of Congress, H . R. 5710, to amend the Act entitled "An Act to expedite the provision of housing in connection with national defense, and for other purposes" (approved October 14, 1940), approved June 28, 1948, enacted that, "Upon the filing of a request therefor as herein provided, the Administrator shall relinquish and transfer, without monetary consideration, to any educational institution all contractual rights (including the right to revenues and other proceeds) and all property right, title, and interest of the United States in and with respect to any temporary housing located on land owned by such institution, or controlled by it and not held by the United States: . . ."; and, Whereas said amendatory Act further provides, "The filing of a request under this section must be made within one hundred and twenty days of the date of enactment of the section and shall be authorized by the board of trustees or other governing body of the institution making the request"; and, Whereas said amendatory Act further provides, "Such request shall be accompanied by an opinion of the chief law officer or legal counsel of the institution making the request to the effect that it has legal authority to make the request, to accept the transfer of and operate any property involved, and to perform its obligations under this section"; and, Whereas the Board of Trustees of the University of Illinois, a public corporation, has heretofore acquired from the United States Government under and by virtue of the provisions of the Act approved October 14, 1940, above referred to, the following described properties:
